dated September 28, 2004. This Company is unable to approve the plat at
this time.

An electrical design to determine our easement requirements will be provided
on the Approved Tentative Plat with working days upon receipt of the plat.
At the customer's request, a design can be provided prior to the Approved
Tentative Plat, however, once a design is provided, any design changes may
be billable to the developer.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


SHEET 1. Revise the third paragraph of the Dedication to read

WE HEREBY GRANT TO THE PUBLIC AND ALL UTILITY COMPANIES ALL PUBLIC EASEMENTS AS SHOWN HEREON FOR THE PURPOSES OF ACCESS, INSTALLATION AND MAINTENANCE OF PUBLIC SEWERS AND UTILITIES AND OTHER USES AS DESIGNATED BY THIS PLAT.

SHEET 2. Delete key note 5 throughout the layout.

A public Sewer Service Agreement for the proposed number of residential lots has been sent to your office. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

We will require a revised set of drawings and a response letter addressing each comment. Additional comments may be made during the review of these documents.

The next submittal of this project will be the 2nd submittal. A check for the review fee of this submittal in the amount of $100.00 made out to PIMA COUNTY TREASURER must accompany the revised set of bluelines and response letter.

SUMMARY: The Final Plat marked "preliminary", and the draft of the CC&R's were received by Engineering on September 29, 2004. Engineering has reviewed the received items. Engineering Division does not recommend approval of the Final Plat at this time. Please address the following comments.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No.2-03.6.6: The draft of the Covenants, Conditions, and Restrictions appear acceptable; please submit original signed copy.
2) DS Sec.2-03.6.5.C.3: Provide boundary closure calculation sheets for both portions of the project.
3) DS Sec.2-03.6.5.C.1.a: For the basis of bearing, provide reference to a record of survey or a recorded plat.
4) DS Sec.2-03.6.5.A: At least one corner of the subdivision needs to be tied by course and distance to one of the quarter / section corners or an established City or County survey monument.
5) DS Sec.2-03.9.3.B: Remove "preliminary…" notation from sheets; the plat will contain the signature and seal of the land surveyor.
6) DS Sec.2-03.7.1.B: If engineering information is provided on the final plat, the seal and signature of the responsible engineer is also required.
a) DS Sec.2-03.6.4.E: Show required drainage setbacks from ponding limits in the basins to structures.
b) DS Sec.2-03.6.4.F: Show the limits of the 100-year floodprone area for Earp Wash, if applicable, in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for all flows of 100 cfs or more.
7) DS Sec.2-03.6.4.G: Provide dimensions for SVT's on plan view for clarification of location of sight visibility triangles.
8) DS Sec.2-03.6.4.H: Show no-vehicular access easements where applicable, ie. on lots 36 - 40 on sheet 2 and lots 38 - 48 on sheet 3.
9) DS Sec.2-03.9.3.J: Since this project is not served by Tucson Water but by Ray Water Company, provide a copy of certification letter from the Arizona Department of Water Resources since the project is not served by the City of Tucson Water Department. Add a general note to the Final Plat regarding certification on assured water supply. Provide on the Final Plat appropriate signatures from Ray Water Co. indicating the same.
10) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Provide the following portions of the assurance package:
a) an original copy of the Agreement to Construct
b) an original copy of the Amendment to Trust
c) an copy of the original Trust Agreement
d) all associated assurance exhibits
e) a copy of the current Title Report
f) copy of a sample warranty deed
11) For this and future projects, please provide three 8½" by 11" location map sheets for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
12) DS Sec.2.4.K & IBC Chap. 36 Sec.13.1: Please provide status of differential grading.
