Ordinance Report, revised Drainage Report, PCWW documents, title report paperwork and a copy of the differential grading request letter to Ernie Duarte dated May 28, 2004 were received by Engineering on June 18, 2004. Engineering has reviewed the received items. The W.A.S.H. Ordinance Report is acceptable. However, the differential grading requirement is still outstanding. See attached response letter. Engineering recommends a conditional approval of the Tentative Plat according to the following conditions. The Drainage and W.A.S.H. Ordinance Reports were reviewed for Tentative Plat purposes only. TENTATIVE PLAT CONDITIONS OF APPROVAL: 1) City of Tucson Development Standards (DS) Section No. 2.4.K & IBC Chap. 36 Sec.13.1: The differential grading letter of engineering justification was received in the submittal package. Procedures for differential grading outlined in this section shall apply and notification responses shall be submitted. As conditional approval the Tentative Plat, this issue must be promptly addressed. Procedures for differential grading outlined in this section shall apply. 2) DS Sec.2-03.2.4.C&6.4.I: Retention/detention areas must be shown in a surveyable and readily retraceable manner. The 100-year ponding limits of the basins shall be labeled with surveyable data. 3) DS Sec.2.4.J: OHE at north side of project shall be clarified on the grading plan to clearly show that the poles are not impacted by any proposed cut slopes for the proposed channels. 4) DS Sec.2.4.K&10-02.14.2.6: The geotechnical recommendations for proposed minimum setbacks for basins from proposed structures (house foundations) shall be shown on the Grading Plan. 5) Per DS Sec.2-03.2.2.G.2, a copy of certification letter from the Arizona Department of Water Resources will be submitted at first submittal of Final Plat. As set forth in the Tucson Code Section 6-34, adopted grading ordinance International Building Code Chapter 36 Section 13.1, the Director of Development Services Center or his assignee provides written consent after the justification is submitted. The engineering reasons, including elevations for maintaining the existing drainage patterns, appear to meet technical justification for grading as described in the letter dated May 28, 2004. We have not at this time reviewed any notification response letters submitted to date; if the notification has not already been done, please prepare and send notification for neighboring residential properties within 100 feet of the proposed lot 20 per the differential grading procedure. Copies of notification of the fill site shall also be sent to the Council Office and the Director of Development Services Department. Said notification shall include reference to this ordinance, the justification presented as the basis for the excess fill, the approval letter from Development Services Department, and the name, address, & phone number of the owner/developer as well as the engineer of record. After responses to the notification letters, it may be necessary to prepare a mitigation plan (i.e. additional setbacks, terracing, enhanced buffering/landscaping, etc.) acceptable to a simple majority of the notified property owners. The acceptability of the mitigation plan by the notified property owners must be documented.
