SUMMARY: Engineering Division has reviewed the Final Plat, Subdivision Assurances Package and Covenants Conditions and Restrictions (CC&R's). Previous review comments (November 2004) have not been fully addressed, and approvals are not recommended at this time. Please address the following comments and provide a response letter addressing each item in a resubmittal:

RESUBMITTALS REQUIRED: REVISED FINAL PLAT AND A COMPLETE, REVISED SUBDIVISION ASSURANCE PACKAGE.

FINAL PLAT:

1. Comment # 1 from the 23 November 2004 review has not been sufficiently addressed. Specifically, common area descriptions for retention/detention facilities must specify these areas as detention/retention basins, rather than present designations as "drainage/recreation" and "landscape/recreation". Each common area must be clearly differentiated from one another in the Title Block and on plan view labeling on all sheets. The common area designations for A-1 and A-2 do not indicate that these areas contain a drainageway, and must also reflect such in the Title Block and all sheets. The plat must clearly differentiate detention/retention areas from drainageways. Please revise all sheets accordingly (DS 2-03.6.4 C).
2. Previous comment # 2 has not been fully addressed. Correct radii dimensioning to reflect 60' radii on sheets 5, 7, 8 and 12 (DS 3-01.10 Figures 5 & 22).

ASSURANCES:

1. Provide a copy of the ORIGINAL Trust agreement - no trust agreement could be found with the present submittal (DS 2-03.6.3 B & C).
2. Revise the description of "The Property" in the "Recitals" paragraph (A) of the Agreement to Construct Subdivision Improvements Third Party Trust, in paragraph 1 of the Amendment to Trust, and in the legal description of the property (Exhibit A - each document), to read exactly as it reads in the Title Block of the plat. Descriptions for common areas must also specify their purpose/use (street, detention/retention basin, drainageway, etc.). All revisions to the Plat Title Block and sheets must match these documents exactly (see plat comment # 1, above).
3. Please indicate the Exhibit letter designation (A), as referenced in paragraph 1 at the heading of the legal description in the "Amendment to Trust" document. Include the CDRC case number (S04-003), and revise the common area descriptions to show consistency with the Plat title blocks, CC&R's, and the Agreement to Construct Subdivision Improvements Recitals paragraph.
4. Revise the common area descriptions in Exhibits A and B in the Agreement to Construct Subdivision Improvements document to reflect changes in response to plat comment #1.

5. Revise Common Area descriptions to match exactly as provided on all other documents, on the cover sheet and in Exhibit A (page 51).
6. Revise Exhibit A to reflect changes in response to Assurances comment # 2, below.

Resubmittal will require a revised Final Plat and a complete, revised subdivision assurance package addressing all of the comments provided above. The Plat may not be recommended for approval prior to Engineering approval of subdivision assurances.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


SHEET 2. As previously indicated on July 28, 2004, please label manhole 1 to be watertight.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the tentative plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.
