SUMMARY: Engineering Division has reviewed the Final Plat, Assurances Package and Covenants Conditions and Restrictions (CC&R's). Approvals are not recommended at this time. Please address the following comments and provide a response letter addressing each item in a resubmittal:

FINAL PLAT:

1. Provide separate letter designations with specific corresponding descriptions for each Common Area (such as retention/detention area, drainageway/easement, open space etc). Each common area must be clearly differentiated from one another in the Title Blocks and on plan view labeling on all sheets (DS 2-03.6.4 C).
2. Review of the knuckle designs northeast of Lot 68 and adjacent to Lot 491 has revealed inconsistent information. Specifically, the radii should be 60' to the property line/right of way. Revise these radius dimensions to reflect 60' radii to the property line. The Tentative Plat should reflect these changes to assure the Tentative and Final Plats are consistent with one another (DS 3-01.10 Figures 5 & 22).
3. The Average Daily Traffic (ADT) exceeds 1000 vehicles per day on all streets within this subdivision. As such, street dimensioning and street cross-sections shall show compliance with Development Standard 3-01.10, Fig. 5.

ASSURANCES:

4. Provide a copy of the original Trust agreement (DS 2-03.6.3 B & C).
5. Revise the description of "The Property" in the "Recitals" paragraph (A) of the Agreement to Construct Subdivision Improvements Third Party Trust, in paragraph 1 of the Amendment to Trust, and in the legal description of the property (Exhibit A - each document), to read exactly as it reads in the Title Block of the plat. Descriptions for common areas must also specify their purpose/use (street, detention/retention basin, etc.). Assure all revisions to the Plat Title Block match these documents exactly (see plat comment # 1-previous comment # 8).
6. Please indicate the Exhibit letter designation (A), as referenced in paragraph 1 at the heading of the legal description in the "Amendment to Trust" document. Include the CDRC case number (S04-003), and revise the common area descriptions to show consistency with the Plat title blocks, CC&R's, and the Agreement to Construct Subdivision Improvements Recitals paragraph.
7. Revise the common area descriptions in Exhibits A and B in the Agreement to Construct Subdivision Improvements document. Please include the CDRC case # (S04-003) on each exhibit.

8. Please revise the Common Area descriptions to match exactly as provided on all other documents, on the cover sheet and in Exhibit A (page 51).
9. Omit the question (in bold/brackets) in section 3.1.2 (page 8).
10. Section 4.7 (page 20) of the CC&R's describes a 10' Landscape/Pedestrian Easement measured from back of curb, yet keynote 1 on the plat identifies a 10' public utility easement. Revise as necessary for consistency, to include revising keynote 1 on the plat, if necessary.
11. Exhibit A should be revised to reflect any changes that occur to the legal description, in response to Assurances comment # 2, below.

Resubmittal will require a revised Final Plat and a complete, revised subdivision assurance package addressing all of the comments provided above. The Plat may not be recommended for approval prior to Engineering approval of subdivision assurances.
