Development Services Department Engineering Division has completed the review of the received items and offers the following comments. FINAL PLAT ASSURANCES COMMENTS: 1) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Provide a revised assurance package which addresses the following: a) For the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST, add the subdivision name "Valle Hermoso" to the description - on the third line of item A under Recitals. b) For the AMENDMENT TO TRUST / THIRD PARTY TRUST address the following: i) Exhibit A is missing as referenced on first page in item 1; attach the exhibit to the Amendment to Trust. ii) Add case number "S04-002" to the top of the first page, beneath "Third Party Trust". c) Near the top of page one of the original Trust Agreement, there is a reference to "Exhibit "A"" from the original trust. Attach Exhibit "A" from the original trust, to the copy of the Original Trust Agreement. 2) DS Sec.2-03.6.5.B: In the Title Report, item 4 in Schedule B refers to rights and easements within land that was an abandoned alley; assure that all easements listed in the title report are labeled on the plat. 3) DS Sec.2-03.6.5.A: Regarding tie to one corner of the subdivision, clarify course to the section corner, establishing tie between two quarter corners, for example. Revision may be submitted prior to submitting mylar. Please submit the complete/revised assurance package items (including the Agreement to Construct, the Amendment to Trust, the Title Report, the warranty deed, and associated other documents, i.e. consent notices), and the revised Final Plat after addressing comments above.
