| 02/11/2005 | ELIZABETH EBERBACH | ENGINEERING | REVIEW | Approv-Cond | DATE: February 11, 2005 TO: Craig Gross; CDRC Coordinator REVIEWER: Elizabeth Eberbach SUBJECT: Engineering review of the Valle Hermosa Final Plat re-submittal ACTIVITY #: S04-002 SUMMARY: The revised Final Plat, copy of the CC&R's, title report schedule, boundary calculation sheet, location map, and a copy of the Drainage Report were received by Engineering on January 28, 2005. Development Services Department Engineering Division has completed the review of the received items and recommends conditional approval once the following comments are addressed. FINAL PLAT CONDITIONS OF APPROVAL: 1) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Provide an assurance package. a) If a third party trust is proposed for the subdivision assurances, provide: i) AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST ii) copy of the original Trust Agreement iii) AMENDMENT TO TRUST / THIRD PARTY TRUST iv) copy of a sample Warranty Deed b) DS Sec.2-03.8.1.D: Provide a signed original copy of the updated Title Report (current within thirty days). c) DS Sec.2-03.6.5.B: Assure that all easements listed in the title report are labeled on the plat. d) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. 2) DS Sec.2-03.6.5.A: Regarding tie to one corner of the subdivision, clarify course to the section corner. Revision may be submitted prior to submitting mylar. Please submit the assurance package items, and the revised Final Plat if necessary after addressing comments above.
