SUMMARY: The Final Plat, closure calculation sheet, original CC&R's and assurance paperwork were received by Development Services Department Engineering Division on December 31, 2003. Engineering Division has reviewed the received items and does not recommend approval of the Final Plat until the following comments are addressed.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.6.1.C: All lettering will be the equivalent of twelve (0.12) point or greater in size. The purpose of this requirement is to assure that all lettering is legible when reproduced or when photographically reduced (microfilmed) for recordkeeping purposes. Under RECORDING DATA and DEDICATION, provide more space for seals.
2) DS Sec.2-03.6.1.D.3: Label section, township, and range; section corners on the project location map.
3) DS Sec.2-03.6.1.E: Check scale on Project Layout map; this map does not scale to 60 scale.
4) DS Sec. 2-03.6.1.H.1: In title block, revise description of Common Area "A" as a Detention / Retention Basin.
5) DS Sec.2-03.6.1.H.3: If the final plat is a resubdivision of a previously recorded plat, indicate the title and the book and page reference of the existing subdivision. (Is this a resubdivision of COT Resubdivision Block 80?)
6) DS Sec.2-03.6.1.J: Line weights will reflect the nature of the line.
7) DS Sec.2-03.6.1.K: Place the subdivision case number (S03-039) on all sheets of the final plat in the lower right hand corner near the title block.
8) DS Sec.2-03.6.1.L: Describe all symbols used on the plat's plan view.
9) DS Sec.2-03.6.2.D: Revise General Note 1 to match the following verbiage: "This plat is subject to the conditions of rezoning case number C9-02-25, unless superseded by a subsequent rezoning ordinance." Add condition 8 as a General Note to first sheet for rezoning case C9-02-25.
10) DS Sec.2-03.6.3.B.1: Assure verbiage, for the Certification of Title in the first paragraph under DEDICATIONS, matches the verbiage per this section: "WE, THE UNDERSIGNED, HEREBY WARRANT THAT WE ARE THE OWNERS AND THE ONLY PARTIES HAVING ANY INTEREST IN THE LAND SHOWN ON THIS PLAT, AND WE CONSENT TO THE SUBDIVISION OF SAID LAND IN THE MANNER SHOWN HEREON."
11) DS Sec.2-03.6.3.B.2.c or d: Revise paragraph 3 per this section to assure verbiage matches.
12) DS Sec.2-03.6.3.D: Under RECORDING DATA, provide a signature line for the Deputy County Recorder.
13) DS Sec.2-03.6.3.D: Under "Assurances", address the following:
a) Revise paragraph to exactly match verbiage in this section: "This is to certify that all improvements, such as streets, sidewalks, sewers, water and utility installation, drainage and flood control facilities, and monuments, required by the City of Tucson have been completed or the future completion of such improvements has been assured by the posting of performance bonds, assurances, or other security as the City of Tucson deems necessary and proper."
b) For the signature lines under the "Assurances" paragraph, replace the signature line title "City of Tucson DSD Engineering Administrator" with "City of Tucson Development Services Department Engineering Administrator".
c) There appears to be a repeat for the Hold Harmless paragraph.
14) DS Sec.2-03.6.4.A: Indicate the name and width of any easements (type) within the subdivision boundary being created by this plat. Label each as public or private, along with the appropriate dedication notation.
15) DS Sec.2-03.6.4.D: Provide location, dimensions, areas in square footage, and purposes of any areas proposed for dedication (such as open spaces, recreation areas, and natural areas) or for reservation for a public use (such as public parks, water facilities, and school sites). Label area between Common Area "C" and buildings.
16) DS Sec.2-03.6.4.F: Show the limits of the 100-year floodprone area in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for all flows of one hundred cfs or more.
17) DS Sec.2-03.6.4.H: Show no-vehicular access easements where applicable.
18) DS Sec.2-03.6.4.I: Show the detention/retention area in a surveyable and readily retraceable manner.
19) DS Sec.2-03.6.5.A: Indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Where a coordinate system has been established by the City Engineer or County Engineer, primary control points may be referenced thereto. The plat must include an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. Clarify whether there is a tie to west section line from centerline bearing of 17th Street. On sheet 2, tie "½" rebar tagged 4399" to project.
20) DS Sec.2-03.6.5.B&C: Indicate tract boundary lines; easements, and other rights-of-way; and property lines of residential units, and common areas, with accurate dimensions, bearings, or deflection angles and radii, arcs, and central angles of all curves. Specifically, address the following:
a) Provide bearings and distances on planview for all common areas.
b) Assure that either the space boundaries or building boundaries are labeled with bearings.
c) In Project Layout Map, clarify "brass cap monument will stamped LS2785".
d) The bearing on sheet 1 and 2 does not match Basis of Bearing paragraph; clarify.
e) Bearing of boundary line west of the Common Area "A" does not match the closure calculation sheet or the title report exhibit. Clarify.
f) Describe and show all boundary monuments on planview on sheet 2. Label as found or to be set.
g) Indicate whether all bearings and distances are measured or calculated. Add "(P)" to legend.
21) DS Sec.2-03.6.1.L: Add the following symbols to the legend:
a) Any new monuments are to be tagged by the RLS.
b) Delineation for 100-year floodplain.
22) DS Sec.2-03.7.1.B: The plat will contain the signature and seal of the land surveyor, registered in the State of Arizona, who prepared the plat. For engineering information (floodplain) is provided on the final plat, the seal and signature of the responsible engineer is also required.
23) DS Sec.2-03.6: The wash room and storage building do not appear to be Final Plat items; clarify or remove any delineations that are not Final Plat related.
24) DS Sec.2-03.7.1.F: If the development is a conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 will be submitted with the initial submittal of the final plat.
25) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the assurances are approved by the City Engineer's Office. Address the following:
a) Revise paragraph B in the Agreement to Construct Subdivision Improvements - Third Party Trust. The completion of improvements shall be in compliance with the "City of Tucson Development Standards Section 1-04.0", not the outdated City Manager's "Directive 1.02.9".
b) Revise paragraph 1 in Amendment to Trust; change "Lots" to "Units" and add descriptions of common areas.
c) All sections of the assurance documentation, must match word-for-word for the descriptions of the common areas listed on the Final Plat pages. Review all documents and check to see that the verbiage for the subdivision description matches the Final Plat. For example, the letter and use for each common area description shall match the Final Plat descriptions and letters. This must be correct in order to prevent any hold up for the assurance review in the City of Tucson's legal offices.
d) Revise paragraph 1 and page 2 of the Notice of Consent to include all common areas.

Prior to resubmittal, schedule a meeting with me to go over your comments. The next submittal should address all the above items. Submit revised Final Plat, revised assurance package, and the updated closure calculation sheet if revised. 5. Remove the existing lot lines shown on the plat as they will no longer apply as result of this plat.

6. The approved tentative plat indicates there are four (4) separate common areas for this project Common Areas "A", "B", "C", and "D" (exclusive). The final plat shows three (3) Common Areas "A", B", and "C". Revise as required.

7. The CC&R's must be revised as follows: On the cover sheet please reference all the subdivision information found in the title block located on each sheet of the final plat (i.e. subdivision name, number of units, and common areas)

This review letter may contain comments pertaining to the concerns of either Department. Separate review letters from PDEQ and PCWWM representatives will not be prepared for this project. The following comments are offered for your use:

1. All Sheets: Add the subdivision plat case number, S03-039, to the title block of each sheet. This number should be shown larger or bolder than the cross reference numbers.

2. We have sent to your office under separate cover a Private Sewer Service Agreement for the proposed number of condominium units. The Sewer Service Agreements must be signed by the owner of record, notarized, and all three originals returned to this office before we can approve the final plat.

3. We have no objection to this final plat, however, until we receive the signed Sewer Service Agreements, we cannot approve it. No re-submittal of bluelines is necessary.
