SUMMARY: Engineering Division of Development Services Department has received and reviewed the Final Plat, Assurance Package, and CC&R's and recommends approval of the Final Plat with the following conditions:

FINAL PLAT AND ASSURANCE PACKAGE CONDITIONS:
1) Regarding the Agreement to Construct and the Amendment to Trust, assure that the title block verbiage for the description of the plat exactly match wording on the assurance document first pages to prevent delays/rejection from the legal office.
2) DS Sec.14.3.4.2: The Covenants, Conditions, and Restrictions (CC&Rs), or on the Final Plat shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. If added tot he CC&R's, revise and please include the page number were this information is located and return the original, signed CC&R's to this office.
For resubmittal, submit the revised Final Plat if the change is made on the plat rather than the CC&R's, revised assurance package, and response letter. If you have any questions, you may call me at 791-5550 extension 2204.
