ACTIVITY: S03-038 SUMMARY: Engineering Division of Development Services Department has received and reviewed the Final Plat, Assurance Package, and CC&R’s and does not recommend approval of the Final Plat at this time. The following items need to be adressed: FINAL PLAT COMMENTS: 1. In order to expedite the plat review and approval, provide the boundary survey and closure calculations report in accordance with D.S. 2-03.6.5.C.3. 2. Please provide a Vehicle No Access Easement at the back of Lot 1 and the beginning of Common Area “C” located north of Fort Lowell Road on Sheet 2 of 4. ASSURANCE PACKAGE COMMENTS: 1. Regarding the Agreement to Construct, add to the assurable item list the fill required to bring the development out of the floodplain per the approved grading plan and the drainage report. 2. The Covenants, Conditions, and Restrictions (CC&Rs), Final Plats, or Development Plans shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. There is an additional easement required by TEP for the line at Lot 29 as shown on the preliminary design dated December 02, 2005. The west 10' of lot 29 should be granted as an easement to TEP or as a PUE. I apologize for not including this easement requirement in m previous review.
