The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


A Sewer Service Agreement for the proposed number of residential lots/wastewater fixture unit equivalents has been sent to your office. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve of the final plat.

SHEET 1. Add the following two General Notes

THE LANDSCAPING WITHIN ALL PUBLIC SEWER EASEMENTS SHOWN HEREON SHALL BE IN ACCORDANCE WITH THE PLANTING GUIDELINES OF PC/COT STANDARD DETAIL WWM A-4.

NO PERMANENT STRUCTURES (I.E., MASONRY WALLS, FENCES, ETC.) MAY BE CONSTRUCTED ON OR THROUGH THE PUBLIC SEWER EASEMENTS SHOWN HEREON WITHOUT SEPARATE WRITTEN CONSENT OF THE PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT.

SHEETS 2-4. Please show the easement keynotes on sheets 2 and 3.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the tentative plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

RESUBMITTAL REQUIRED: Final Plat, Assurance Package, and CC&R's

Engineering has reviewed the received items and does not recommend approval of the Final Plat.


1. If the plat contains more than one (1) sheet, a small index drawing of the site showing the area represented on each sheet is to be placed on the first sheet. Exception: The project-location map required in Sec. 2-03.6.1.D may be used as the index map on plats having only two (2) or three (3) sheets. DS 2-03.6.1.E Sheet 4 is not accounted for in the location map.

2. If applicable, show no-vehicular access easements. DS 2-03.6.4.H

3. In order to expedite the plat review and approval, provide the boundary survey and closure calculations report in accordance with D.S. 2-03.6.5.C.3.

4. General Note 5 states "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Lots 1,2, 36-61." This note may not be needed depending on the status of the CLOMR Case # 04-09-0919K. If the LOMR has been approved then these lots are no longer in need of a Flood Plain Use Permit. What is the status of the LOMR?

5. Lots 1 and 2 do not appear to be affected by the FEMA Floodplain. Please verify why General Note 5 includes them as needing a Flood Plain Use Permit.

6. DS Sec.2-03.7.1.B: When engineering information (floodplain) is provided on the final plat, the seal and signature of the responsible engineer is also required. Provide signature and seal of Civil Engineers for the project. If one of the Engineers that sealed the plans is also responsible for the floodplain boundaries please revise the certification portion of the plat to include floodplain boundaries along with their signature and seal.

7. There is some linework on sheet 2 within Common Area C at the southwest portion of this proposed project that appears to be easement linework, but is not clearly defined. Please indicate what this linework is and if necessary update the easement table.

8. If applicable, the following may be needed on the final plat, and will be needed on the grading plan. The City of Tucson Development Standards (DS) Section No.2-03.6.2: In reference to the ADOT correspondence, consider adding a General Note to the Final Plat and add the note to the grading plan disclosing that the access to the frontage road may be limited for the duration of the ADOT Interstate reconstruction.

9. The Covenants, Conditions, and Restrictions (CC&Rs), Final Plats, or Development Plans shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. SMDDFM 14.3.4.2

10. For resubmittal, submit the revised Final Plat, assurance package and any other associated documentation.

11. DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Submit the following for other portions of the assurance package:
a) If a third party trust is proposed for the subdivision assurances, provide:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S03-038" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the Title Report.
b) DS Sec.2-03.6.5.B: Address the following easement comments:
i) Label Bk/pg or Dkt/pg for the utility easements that are to be abandoned.
ii) Assure that any/all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. In response letter, please explain whether any easement items in Schedule B are not shown on the plat.
c) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
