SUBJECT: Engineering review of the Olsen Condominiums Final Plat. The activity number is S03-036.

SUMMARY: The Final Plat, CC&Rs and Assurances were received by Engineering on May 27, 2004. Engineering has reviewed the received items and does not recommend approval of the Final Plat, the Assurances, or the CC&Rs.

RESUBMITTAL REQUIRED: FP, ASSURANCES, CC&Rs

SUBMITTAL REQUIRED: BOUNDARY CLOSURE CALCS

The next submittal must address the following items:

FINAL PLAT

1. Tentative Plat approval is required prior to Final Plat approval. The Tentative Plat is still in the review process. Changes made to the Tentative Plat must be reflected on the Final Plat.

2. Include the Assurance Package with the next Final Plat submittal. This package must include the original Third Party Trust, the original Amendment to Trust, a copy of the Trust Agreement, a copy of the Deed, and a recent Title Report. The Final Plat will not be approved until all of the above Assurance documents are received and approved.

3. The City of Tucson legal department will not approve the Final Plat and Assurances unless the language identifying the subdivision in the title block of the Final Plat exactly matches the language in the Assurances that identify the subdivision. The Final Plat says, "Olsen Condominiums Condominium Units 1-18, Common Elements "A" & "B", and Limited Common Elements". The Assurances say, "Buildings 1 thru 18 and Common Areas "A" and "B" of Olsen Condominums".

4. The Title Block must say, "18 Condominium Units" not, "Condominium Units 1-18". DS 2-03.6.1.H.1 The Assurances must match the Title Block (see comment 3 above).

5. Eliminate item 9 from the list of assurable items in the Third Party Trust Agreement.

6. Include a copy of the CC&Rs with the next Final Plat submittal. The specific maintenance notes specified in the Standards Manual for Drainage Design and Floodplain Management, SMDDFM, 14.3.2 must be included in the CC&Rs. The term "owner" in the maintenance notes is to be replaced with "Homeowners Association".

7. The Plat shows an unidentified easement line between adjacent TP's. What is this easement?

8. Provide a copy of the boundary closure calculations with the next Final Plat submit

Should there be any changes requested by other CDRC members, however, the approval is void, and we request copies of those changes to insure that those changes do not affect zoning requirements.

Please provide the executed final plat for signature, and a memo stating that the members of the CDRC have approved the final plat. When these items are received, along with forty-four half-sized copies of the plat, the final plat will be scheduled for consideration at the next available Mayor and Council meeting.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


We have sent to your office under separate cover three originals of a Sewer Service Agreement for the proposed number of residential units. Once the three originals of the Agreement have been signed by the Owner of Record, and notarized, they must be returned to Wastewater Management in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.
