THRU: FROM: ____________________________________ representing the Pima County Departments of Wastewater Management and Environmental Quality SUBJECT: Silverbell Vista, Lots 1-40 and Common Areas A-C - Submittal S03-033 The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. SHEET 1. Revise the third paragraph of the Dedication to read PRIVATE STREETS, DRAINAGEWAYS AND COMMON AREAS AS SHOWN HEREON ARE RESERVED FOR THE PRIVATE USE AND CONVENIENCE OF ALL OWNERS OF PROPERTY WITHIN THIS SUBDIVISION AND ARE GRANTED AS EASEMENTS TO THE PUBLIC AND ALL UTILITY COMPANIES FOR THE INSTALLATION AND MAINTENANCE OF ABOVEGROUND AND UNDERGROUND UTILITIES AND PUBLIC SEWERS. TITLE TO THE LAND ALL COMMON AREAS SHALL BE IN VESTED IN AN ASSOCIATION OF INDIVIDUAL LOT OWNERS AS ESTBLISHED BY COVENANTS, CONDITIONS AND RESTRICTIONS RECORDED IN DOCKET _______ AT PAGES ________, IN THE OFFICE OF THE PIMA COUNTY RECORDER. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet. The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter. SUMMARY: Engineering Division has reviewed the Final Plat and CC&R's. Approval is not recommended at this time. The following comments must be addressed prior to resubmittal: 1. Please omit the maintenance access easement depicted at the northeast corner of the site, per previous discussions. 2. 100-year Floodplain limits that are entirely contained within a street section or constructed drainageway shall be labeled as such on the plat, or a general note shall be included on the plat, which states the same (DS 10-02.5.2.3 3. Provide a note stating that the owner/developer agrees to (1) have an Arizona Registered Professional Land Surveyor certify the finished floor elevations of all new structures located within the floodplain; and (2) obtain a floodplain use permit from the City Engineer (DS 10-02.5.2.6). 4. Include in the CC&R's, or add a note to the plat stating: (a) that the owner(s) shall be solely responsible for, operation, maintenance and liability for the drainage basin(s); (b) That the owner(s) shall have an Arizona Registered professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once a year, and that these regular inspection reports will be on file with the owner for review by city staff, upon written request; (c) that city staff may periodically inspect the drainage and detention/retention facilities to verify scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owners(s) agree to reimburse the city for any and all costs associated with maintaining the drainage and detention/retention facilities, should the city find the owner(s) deficient in their obligation to adequately operate and maintain their facilities (DS 10-02.14.3.2). 5. Revise the Certification of Survey paragraph to reflect the language specified for "…all existing and proposed survey monuments and markers shown are correctly described. I further certify that this plat was prepared under my direction"(DS 3-02.6.3 A). 6. Revise the Dedication paragraph to reflect dedications to the Public or the City of Tucson - not Pima County; and revise or omit the dedication of easements in this paragraph (DS 2-03.6.3 B 2 a). 7. If applicable, include a Beneficiary block on the Title page (DS 2-03.6.3 C). 8. Please replace the signature block title of "City of Tucson Engineer" to "City of Tucson Development Services Department Engineering Division Administrator". 9. Provide separate letter designations with specific descriptions of each Common Area (retention/detention areas and drainageways/easements must be differentiated from one another), in the Title Block on sheet 1 and in the Title Block and on plan view labeling on sheet 2. 10. Show the limits of 100-year floodprone areas in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for all flows of 100-cfs or more (DS 2-03.6.4 F). 11. Show detention/retention basin 100-year ponding limits in a surveyable and readily retraceable manner (DS 2-03.6.4 F). 12. Provide boundary survey closure calculations (DS 2-03.6.5). 13. Omit or provide a clear description with tie-down information for the additional (radial?) ¼ corner tie-in depicted east of Silverbell Road (DS 2-03.6.5 A). 14. Ensure all tract boundary lines; easements, and other rights-of-way; and property lines of residential units, and common areas, with accurate dimensions, bearings, or deflection angles and radii, arcs and central angles of all curves are indicated and labeled properly (DS Sec.2-03.6.5.B&C). 15. Note that a ½" iron rod will be set at all corners upon completion of construction (DS 2-03.6.5 C 4 b). 16. Provide additional monuments to be set along the street monument line at all points of curvature and points of reverse curves (south and west of Lot 35) (DS 2-03.6.5 C 6). 17. City of Tucson Development Standards (DS) 1-04.1 requires all subdivision improvements be completed prior to transmittal of a Final Plat to Mayor and Council for consideration. Alternatives include posting of a Performance Bond, establishing a Cash Escrow Account, providing a Letter of Credit or providing Subdivision Assurances. Please address this requirement prior to, or concurrent with a Final Plat resubmittal. 18. Include a current title report with a subdivision assurance package submittal (DS 1-04.2 and 2-03.7.1). 19. Provide written documentation/verification from Tucson Department of Transportation (TDOT) demonstrating compliance with, or consent to construct or contribute funding toward all required improvements stipulated as conditions of rezoning for this project. These include the items listed in rezoning condition numbers 10, 11, 16 (a-c), 17 & 18. The Final Plat may not be recommended for Mayor and Council consideration prior to demonstration of conformance to these conditions. GENERAL COMMENT: The consultant may wish to insert a period between the words "sewers" and "title" and between the words "Recorder" and "The Association" in the third paragraph under "Dedication" (DS 2-03.6.3 B 2 c). Resubmittal will require a revised Final Plat, boundary survey closure calculations and 2 subdivision assurance packages, addressing all of the comments provided above. The Plat may not be recommended for approval prior to Engineering approval of subdivision assurances.
