The activity number is S03-012. SUMMARY: The Final Plat was received by Engineering on June 14, 2003. Engineering has reviewed the received item and does not recommend approval of the Final Plat RESUBMITTAL REQUIRED: FP The next submittal must address the following items: FINAL PLAT 1. Please provide a copy of the boundary closure calculations with the next Final Plat submittal. 2. General Note 2 says total units is 82. The Title Block says 80. Correct. 3. The Acknowledgment section refers to the "TRUST OFFICIAL". This should be the owner. 4. The Assurance section must read, "THIS IS TO CERTIFY THAT THE COMPLETION OF ALL IMPROVEMENTS SUCH AS STREETS, SIDEWALKS, SEWER, WATER AND UTILITY INSTALLATION, DRAINAGE AND FLOOD CONTROL FACILITIES AND MONUMENTS REQUUREID BY THE CITY OF TUCSON HAVE BEEN COMPLETED OR THE FUTURE COMPLETION OF SUCH IMPROVEMENTS HAS BEEN ASSURED BY THE BONDS, ASSURANCES, OR OTHER SECURITY AS THE CITY OF TUCSON DEEMS NECESSARY AND PROPER. CITY OF TUCSON DEVELOPMENT SERVICES DEPARTMENT DIRECTOR CITY OF TUCSON DEVELOPMENT SERVICES DEPARTMENT ENGINEERING ADMINISTRATOR. 5. Place the subdivision case number (S03-012) in the lower right corner of the plat next to the title block on each sheet. DS 2-03.6.1.K 6. Sheet 3 below unit 12/11 says, "SEE UNIT 104 & 204". There are no units labeled 104 and 204. Correct. 7. Sheet 3 shows measurements in feet-inches and also in decimal feet. The plat must show consistent units of measurement. Correct. 8. Place a note on the plat that all building corners are at right angles. DS 2-03.6.5.B 9. At least one wall on each building group must have a bearing associated with it. DS 2-03.6.5.B 10. The one and two bedroom typical details on Sheet 2 refer to units in the 100s and 200s. These are not on the plan. Correct. 11. The one and two bedroom typical details do not match all of the units shown on the plan. Also, the measurements shown on these typical details do not correlate with the overall dimensions shown on the plan. Correct. 12. The Two-Bedroom typical detail Sheet 2 specifies the inside dimensions as 21'-6" X 29'-6". This would result in an inside area of 634.25 sq.ft. The plan shows 631.85. The volume calculation is also incorrect. 13. The One-Bedroom typical detail shows 20' X 30' outside dimensions. Subtracting out the notch results in an outside area of 549.6 sq.ft. The plan shows an inside area of 570.82 sq. ft. The volume calculation is also incorrect. 14. Provide a bearing for the north property boundary. Provide a bearing for the west property boundary. DS 2-03.6.5.B 15. At least one corner of the subdivision must be tied by course and distance to a sections corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. DS 2-03.6.5.A 16. This response is not to be construed as a commitment for conveyance capacity allocation, but rather an analysis of the existing sewerage system as of this date. 2. Based on our records for this property, this project would qualify for Non-Participating sewer connection fee rates. However, a final determination of this status cannot be made until approval of the sewer construction plans and/or preparation of the sewer service agreement. 3. Add the subdivision plat case number, S03-012, to the title block of each sheet. This number should be shown larger or bolder than the cross reference numbers. 4. No formal sewer service agreement for this project will be required. 5. The final plat is hereby approved. The required changes may be shown on the Mylars. Reference all recorded subdivisions by book and page number in the location map. DS 2-03.6.1.D.2 2. Revise the number of units in the title block, the general notes and on the drawing to be consistent / correct. DS 2-03.6.1.H & .6.2.B 3. The Approval paragraph and the Recording Data block must be placed immediately adjacent to each another. Please revise. DS 2-03.6.3.D 4. Any subdivider proposing to convert existing apartment house or mobile home park to a condominium, by filing a subdivision plat shall have satisfied the following requirements prior to approval of a final plat by the Mayor and Council. A. Notice of Intent to Convert. The subdivider shall submit an affidavit stating that the subdivider has provided or will provide written notice of the subdivider's intent to convert to all tenants of units to be converted, beginning not less than one hundred twenty (120) days prior to the date on which the first unit is offered for sale, and will continue to provide such notice to prospective tenants until all units have been sold. B. Exclusive Right to Purchase. The subdivider shall submit an affidavit stating that the subdivider will provide existing tenants an exclusive right to purchase the unit the tenant leases at a price which is not more than the price at which the subdivider intends to offer the unit to the general public for a period of not less than sixty (60) days from the date a tenant's unit is offered for sale. C. Statement of Availability of Other Rental Units. The subdivider shall submit an affidavit that the subdivider will provide to each tenant, who has indicated to the subdivider his/her intention not to exercise his/her right to purchase, a written statement listing at least three (3) rental units unique to that tenant of comparable size and price to the unit occupied by the tenant. D. Relocation Payments. The subdivider shall submit an affidavit stating that the subdivider will provide to tenants a relocation payment of three hundred fifty dollars ($350.00) per residential unit to be paid prior to termination of the tenant's occupancy, including written notice of the availability of such payment prior to termination, provided that: 1. The tenant has occupied his unit for at least two (2) years prior to the date on which the tenant was eligible to receive a notice of intent to convert pursuant to Sec. 4.1.9.1.A. 2. The tenant has made a written request to the subdivider for the relocation payment. 3. The tenant has a total annual income at or below maximum eligibility limits established by the U.S. Department of Housing and Urban Development for participation in the Section 8 Housing Assistance Payments Program or is sixty-two (62) years of age or older. E. Housing Code Compliance. The subdivider shall submit an affidavit stating that the units to be converted meet the applicable standards of the Housing Code, Tucson Code, Chapter 16. Disclosure Requirements. Any subdivider who files a final plat for a condominium, whether for the purpose of new development or the subdivision of an existing development, shall submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following. A. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase. B. A report from a licensed pest control operator on each building or structure and each unit within the building or structure. C. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data. D. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied. E. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety. 1. Accessibility of buildings and structures to fire-fighting equipment; and 2. Proximity and frequency of fire hydrants. Please provide all applicable documentaion listed above for a condominium conversion prior to final plat approval. LUC 4.1.9.1 LUC 4.1.9.2 5. Place the subdivision case number (S03-0012) on all sheets of the final plat in the lower right hand corner near the title block. DS 2-03.6.1.K 6. Please renumber the notes on sheet 3 of 3 to be numerically ordered. 9. A two inch margin must be maintained between along the left side and a ½-inch margin on all other sides.
