| 12/29/2003 | ELIZABETH EBERBACH | ENGINEERING | REVIEW | Denied | SUBJECT: Silverbell Trails Final Plat 2nd Submittal Engineering Review REVIEWER: Elizabeth Eberbach ACTIVITY NUMBER: S03-007 SUMMARY: The boundary closure sheet, revised Final Plat, copy of the CC&R's, and assurance paperwork were received by Engineering on December 15, 2003. Development Services Department Engineering Division has completed a review of the received items and does not recommend approval until the remaining comments are adequately addressed. FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.4.I: As stated in previous comments, detention/retention areas must be shown in a surveyable and readily retraceable manner. The basin area is labeled as "DRAINAGE" on the Final Plat common area title block descriptions; the basin area needs to be called out as a "RETENTION / DETENTION BASIN". 2) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. If the descriptions of the common areas are changed on the Final Plat title block (due to above comment), the Exhibit "A" legal description in both the AMENDMENT TO TRUST / THIRD PARTY TRUST and the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST must be revised to match the Final Plat title block descriptions. The CC&R's description of the subdivision needs to also match. 3) DS Sec.2-03.6.6: Provide an original, signed copy of the Covenants, Conditions, and Restrictions (CC&Rs) describing retention/detention basin maintenance, with verbiage within the CC&R's per DS Sections 10-02. XIV.14.3.2 & 3. Otherwise, the verbiage from sections 10-02. XIV.14.3.2 & 3 needs to be added to the Final Plat as general notes. See attached copy of this section. 4) With the submittal of the final plat mylar, any references to 2003 shall be updated to 2004. Also, any assurance paperwork will need to be updated. The next submittal should address all the above items. Please submit the revised assurance package items, revised CC&R's, and the revised Final Plat.
