SHEET 1. In the Dedication, include the trust name and number.

We have sent to your office under separate cover a Public Sewer Service Agreement for
the proposed number of residential lots. Once the Sewer Service Agreement has been signed by the Owner of Record, the three originals should be returned to Wastewater Management in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Subject to the above conditions, there is no objection to this Final Plat, however, until the signed Sewer Service Agreements have been returned, we cannot approve it.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use:


The three signed and notarized originals of the Sewer Service Agreement have been received by our office and forwarded to PCWMD for further processing.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat subject to the remaining conditions of our review letter dated March 02, 2004.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUMMARY: The Final Plat, Boundary Description, closure calculation sheet, and portions of the assurance paperwork including Schedule A & B, were received by Engineering on February 3, 2004. Development Services Department Engineering Division has done a review of the received items and does not recommend approval of the Final Plat at this time.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.6.4.K: Since this final plat is a multiphased project, indicate the access easements or public streets on this plat that will guarantee the turn-around. Label and delineate easements for turn-around areas at ends of Bright Sun, Desert Walk, and Sunrise Valley streets.
2) DS Sec.2-03.6.5.B: Provide drainage easements for the proposed interceptor swale as well as drainage improvements beyond the Phase 2 boundary line.
3) DS Sec.2-03.6.1.D.2: Remove delineations of lot lines and roadways for phase 3 on sheet 3; the text label for future Tierra Vista Phase III may remain.
4) Show delineation and provide Book and page of abandonment for Britannia Way right-of-way on sheet 3.
5) DS Sec.2-03.7.1.D: Assure that any applicable rezoning conditions have been met per Bk52 pg56 General Notes 7 and 8.
6) DS Sec.2-03.6.6.A: Revise CC&R's:
a) Provide CC&R's to reflect this phase of the project.
b) Add basin maintenance information per DS Sec.10-02.14.3.2.
7) DS Sec.2-03.6.4.I: Retention/detention areas must be shown in a surveyable and readily retraceable manner. The 100-year ponding limits of the basins shall be labeled with surveyable data. The basin areas, labeled as Common Areas "A" "DRAINAGE" on the Final Plat, need clarification. In the Title Block, the common area descriptions and the basin area need to be differentiated; label the basin areas exclusively as "RETENTION / DETENTION BASIN" and label the other areas (such as channels) as "DRAINAGE".
8) DS Sec.2-03.6.1.L: Add 100-year ponding limits to legend. Add easement delineation to legend.
9) DS Sec.2-03.8.1.B: For Schedule A, provide an updated Exhibit "A" to reflect the correct lots of Tucson International Gateway Center for this phase. The Exhibit "A" states that this project includes lots 21 through 31, however the plats show that for this phase it will be combining lots 30 through 38 and perhaps portions of lots 39 through 41. Clarify and / or update exhibit(s).
10) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Address the following for other portions of the assurance package:
a) Revise any sheets of the assurance paperwork to reflect any change in descriptions of the common areas.
b) Provide AMENDMENT TO TRUST / THIRD PARTY TRUST.
c) Provide AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST.
d) Provide copy of sample Warranty Deed.
e) DS Sec.2-03.8.1.D: Provide a copy of the updated Title Report (current within thirty days).
f) DS Sec.2-03.6.5.B: Assure that any and all easements listed in the forthcoming title report are labeled on the plat.
g) For this and future projects, please provide two 8½" by 11" location map sheets for assurance submittals that go to Mayor & Council.
h) If the descriptions of the common areas are changed on the Final Plat title block (due to above comments), the CC&R's descriptions of the subdivision common areas need to match the Final Plat title block descriptions.
11) DS Sec.2-03.6.3.A: Provide signature and seal for Certification of Engineering on sheet 1.
12) DS Sec.2-03.6.1.C: Clean up text overlap on sheet 3.

A final complete drainage report compiled with any drainage addenda and errata will be required to be submitted at grading plan or revised Final Plat review stage, whichever is later. For resubmittal, please submit the assurance package items, the updated title report, location map sheets, updated signed copy of the CC&R's, and the revised Final Plat.
