The Development Plan for this project was approved showing an enclosure for both recycling and refuse containers. Since that approval, ESD has been coordinating with the owner of this project as well as the other adjacent owners to place a joint use compactor on the Illegal Pete’s site. This is to be constructed in the location of the approved refuse and recycling enclosure. Until such time as the compactor and its enclosure are constructed and functioning on the Illegal Pete’s site, there has been an additional refuse container placed on the adjacent Frog and Firkin property for Illegal Pete’s use. The placement of the additional container does not impact the parking or ingress/egress of either of these two restaurant uses. Both Illegal Pete’s and Frog and Firkin will share the existing Frog and Firkin recycling container. If for some reason the joint use compactor and its enclosure are not constructed, the Illegal Pete’s owner will be required to construct the refuse and recycling enclosure shown on the approved Development Plan. The TSMR is approved, however the location and the description of the interim servicing of the Illegal Pete’s in the TSMR package is incorrect.
