01. Zoning has reviewed the TSMR request and cannot support the request to eliminate the sidewalk requirement. The consultant has made no attempt to modify the sidewalk requirements or site design to accommodate the required sidewalk per the Technical Standards. To eliminate the requirement for a sidewalk requires approval through the Board of Adjustment process.

03/11/2014 LOREN MAKUS ENGINEERING REVIEW Approved Per Technical Standards Manual 1-01.6.1.A the applicant asked for an exception to TSM7-01-4.1.B which requires a sidewalk next to an access lane or a PAAL on the side where buildings are located.
According to TSM 1-01.6.1.A the director may allow modifications and exceptions to the technical standards in accordance with the findings listed in TSM 1-01.6.5.
The request meets the findings requirements:
A. (When applicable, the TSMR complies with any additional modification provisions required by the affected technical standard) No additional modification provisions are required;
B. (There are practical difficulties which prevent the strict application of the Technical Standards);
C. (The modification is in conformity with the intent and purpose of the Technical Standard and such modification addresses health, life, and safety considerations);an alternate route for pedestrians is proposed on one side of the existing PAAL/parking areas in both locations and,
D. (The strict application of the Technical Standard fails to accomplish the intent of the Technical Standard due to such reasons as existing conditions, the character of the area, or existing site or location constraints, etc) For B and D, the existing site has two existing buildings with no sidewalk/ pedestrian refuge areas.

The Engineering Section recommends approval.
