This is highly unlikely and may tempt pedestrians into making a path of their own across the natural drainageway.

In addition, since the proposed site design relies on the Houghton Road sidewalk, access from the remainder of the site to Building #9 can't be ensured during times that Houghton Road is under construction. Houghton Road is proposed for RTA-funded improvements.

Staff offers the following comments:

This DSMR request is for tentative plat/development plan D07-0014, which is currently under review for compliance to rezoning case number C9-06-03. The applicant is requesting modification from development standard 2-08.3.1 that requires a continuous pedestrian circulation within all developments. The applicant reasons that Building 9 is separated from the rest of the shopping center pads by a natural drainage way, and given that an alternate access to the center is provided by using the sidewalk along Houghton Road.

The South Pantano Area Plan calls out for commercial developments to be integrated and to provide adequate access to all development pads. The rezoning conditions (C9-06-03) for this development specifically required that there be a pedestrian path along the natural drainage way onsite that abuts Building 9 development pad. The purpose of this rezoning condition was that the shopping center would provide onsite connectivity. Although the applicant cites that Building 9 can be accessed to the rest of the shopping center via the sidewalk along Houghton Road, this appears to be contrary to the goals of the South Pantano Area Plan and to rezoning case C9-06-03. Also this DSMR request if approved could have an adverse safety impact on pedestrian circulation and connectivity. It appears that pedestrians traveling along the internal pedestrian circulation path from Buildings 6 and 5 can not safely access Building 9 across the proposed bridge and roadway unless a sidewalk is installed.

Development Standard 2-08.3.1 identifies areas within the development that need to be connected to include, but not limited to, all buildings, all parking spaces, all recreational and common areas. Although this development standard appears to give some flexibility for requiring a pedestrian circulation path for those areas not required to provide an accessible route, Building 9 needs to be connected internally to the shopping center’s continuous pedestrian circulation path, and the rest of the shopping center’s buildings.

DUPD staff can not recommend approval of DS08-01. The shopping center development plan needs to provide pedestrian access from the southwest corner of Building 9 pad across the natural drainage way/bridge/roadway and connect with the proposed internal pedestrian circulation path.
