1. To eliminate a sidewalk requires a Board of Adjustment variance. To modify the sidewalk location is allowed through a DSMR approval. While the applicant does not justify or demonstrate the modification for the sidewalk requirement along the east site (property line) of the development, it is clear that the sidewalk in this location will serve no purpose and will not be utilized. Zoning will support modifying the sidewalk location based on the design as shown on the plan with two conditions. A crosswalk/connection is to be provided from the southeast sidewalk to the sidewalk along the block north of the southern unit's block (see attached redline) and that all CDRC members including the CDRC Manager approve the design as shown on the plan.

2. Zoning supports the request for a DSMR for the Knuckle as requested. Technically a knuckle is not required because the vehicular use areas are not considered streets. The vehicular use areas are PAALs and the knuckle standard does not apply.

The Development Standard Modification Requests (DSMRs) listed above have been Approved by the CRDC committee with the following conditions:

1) Tentative plat is revised to show sidewalks, crosswalks and ADA-compliant ramps as detailed in the attached drawings from Engineering and Zoning.

PLEASE NOTE THAT A GENERAL NOTE MUST BE ADDED TO THE TENTATIVE PLAT WHICH STATES THE DSMR CASE NUMBER, DATE OF APPROVAL, MODIFICATIONS GRANTED, AND CONDITIONS IMPOSED. DS 2-08.4.1.B - DSD Engineering objects to elimination of the sidewalk adjacent and parallel to the PAAL on the side where buildings are located. The applicant does not provide sufficient justification for the request to eliminate sidewalk in these areas. This is a new development that should incorporate adequate planning to accommodate sidewalk. As it could not be determined where the applicant was requesting the DSMR, Engineering has provided a mark-up where it would not oppose the elimination of sidewalk (yellow) provided that ADA-compliant ramps are installed where indicated (pink). One copy may be provided to the applicant and one should be retained with the file. Engineering will not support any significant deviation from the modification as shown on the mark-up.

The DSD Engineering Division has no objection to the approval of the Development Standard Modification Request to Dev. Std. 3-01 (Figure 22) for the use of the radii as shown in lieu of the standard knuckle.
