DSD Engineering has no objection to the approval of a DSMR to Dev. Std. 3-05.2.2.B.1 to allow a setback of less than 5' for a pedestrian refuge area between an enclosed structure and PAAL.

DSD Engineering has no objection to approval of a DSMR to Dev. Std. 3-05.2.2.B.3 to allow a distance of less than 2' between a PAAL and a wall, screen, or other obstruction.

COMMENTS: Approved with conditions

1. Zoning will support the DSMR request to re-locate the required sidewalks as presented on the submitted plan due to existing site and building conditions and constraints.

2. Note to the CDRC Manager: The applicant should also have requested a DSMR for the 2-foot setback from the PAAL to the property line along the West Side. Zoning is willing to support this DSMR if requested due to existing site and building conditions and constraints.
It is also worth mentioning that the plan that has been submitted for review of the DSMR request does not match the recently re-submitted plan for site review. There are changes to the revised plan that are not indicated on the DSMR plan but the changes do not affect the DSMR request. Also the annotation on the revised site plan indicates town homes instead of Condominiums. The Zoning reviewer has made review comments related to these annotations and requested clarification. If this development is proposed for town homes a tentative plan and final plat will be required.
