COMMENTS: DSMR cannot be supported by Zoning

1. Zoning cannot support the requested DSMR's. The proposed street cross section eliminates the required sidewalks and the street design indicates the placement of the drainageway between the pedestrian area and the property. The design does not demonstrate how access whether vehicular or pedestrian is provided to the affected lots.

2. This development is designed as an RCP therefore sidewalk cannot be modified or eliminated through a DSMR. A Board of Adjustment Variance is required. In addition within an RCP development 25 % of the units must be barrier free accessible. The plan does not demonstrate how accessibility will be provided.

3. This site is a vacant piece of land, which should be redesigned to comply with all development standards and Land Use Code criteria.

10/06/2006 JCLARK3 ENV SVCS REVIEW Denied Object to the reduction of the Cul-de-sac radius. Service trucks opposite side bumper for clearance has a 50 feet radius. Do not see why this radius cannot be maintained.

Per meeting with the developer and Engineer on 10/30/2006, ES has no problem with approving the project since the pavement width will not be reduced.

The Development Standard Modification Requests (DSMRs) listed above have been Approved by the CRDC committee with the following conditions:

1) The above listed modifications do not change the width of the proposed pavement for the streets or cul-de-sacs in this subdivision,
2) Add a note to the tentative plat that states "all homes over 3600 square feet are to have automatic fire sprinklers",
3) These modification do not waive the requirements for pedestrian access required by the Land Use Code for Residential Cluster Projects.
