04/10/2006 | MATT FLICK | ENGINEERING | REVIEW | Denied | The Engineering Division objects to the granting of the DSMR to DS 10-01.4 (pg. 78) for the basin located between the proposed l-shaped building and an existing building. The applicant has failed to show why strict application of the Development Standard fails to accomplish the intent of the Development Standard due to such reasons as existing conditions, the character of the area, or existing site or location constraints, etc. The constraint, in this case, seems to be self-imposed and is not the result of existing constraints or the character of the area. Basins are to have slopes no steeper than 4:1 where depths exceed three feet; 3:1 for unprotected slopes and 2:1 for protected slopes for depths less than three feet. DS 10-01.4 The request seems to indicate that, since the basin has been located in a low visibility area of the site and a portion of the site was developed some time ago without detention/retention, it is not intended to serve as a multi-use facility. Based upon the materials supplied by the applicant, it appears there is no recreational or multi use facility within the basin. The Detention/Retention Manual establishes that "The goal of all detention/retention basins is to be multi-use" . This does not apply only to basins in residential areas. There is ample opportunity for the applicant to design a multi-use basin in a business-zoned setting. The basin design, as shown on the proposed development plan, looks to be designed to allow maximum use of the site area. This is not an existing constraint. This is a self-imposed constraint. Based upon the flatness of the site, the basin could have been locate just about anywhere. Locating it in an area of low visibility, by choice, is not a justification for not designing it as a multi-use basin. It is intended that detention/retention facilities designed in accordance with the guidelines presented herein will meet the goal of resulting in detention/retention facilities which are multi-use and visually appealing. "One of the major objectives of this manual (Detention/Retention Manual) is to provide guidelines towards ensuring that future retention/detention facilities will be planned and designed in such a way that they will be considered as amenities by the affected community. In an attempt to achieve this goal, Chapter 4 provides detailed policies and criteria regarding grading and landscaping of proposed detention/retention basins for multiple uses." The Land Use Code requires that basins be landscaped to enhance the natural configuration of the basin and establishes DS 10-01 as the design criteria to be followed. LUC 3.7.4.3. The Land Use Code requirement is to designed to create basins that serve as visual amenities or focal points, thus meeting the multi-purpose standard. The applicant should pursue redesign of the basin slopes and design the basin as a multi use basin. Design of the basin for multi-use may also facilitate the design of a maintenance/access ramp in accordance with the development standards. Matt Flick Engineering Manager |
