COMMENTS: Zoning cannot support the DSMR request for the following reasons.

1. No modification is proposed to the development standard and is required when requesting a DSMR. In addition the sidewalk is to provide an accessible route which has not been addressed on the plan.

2. A DSMR cannot be used to eliminate a development standard. To eliminate the sidewalk completely requires a variance approval through the board of adjustments.
