DSD Engineering does not support any DSMR for DS 2-08.4.1.A, DS 2-08.4.1.B (and Figure 1) and 2-08.4.1.E.

DSD Engineering has no objection to the granting of a DSMR to DS 2-08.4.1.C (and Figure 2) for the omission of a sidewalk along the west side of the existing building.
02/11/2005 JCLARK3 ENV SVCS REVIEW Denied * A site visit on February 10 and 11 reveiled that the existing private refuse container is in front of the building. The container seems to be in a fenced area that is in the public righ of way.
* The dumpster area as shown on the submitted plans cannot be serviced to comply with the Development Standards for an on-site pickup service. A service vehicle would have to back out into the public right of way which is not allowed.
* There is question with the access because the elevation of the improved Nogales Highway is approximately six feet higher thanthe fromtage property line.
* The bussiness seems to be utilizing the roadway right of way for parking. Maybe this area could be leased from the state for a turnaround could be provided for the service trucks.

The applicant is requesting relief from Development Standard 2-08.4.1.C that requires a sidewalk be provided adjacent to any parking space accessed by a PAAL where the space is located on the same side of the PAAL as any building, and no other parking spaces or PAALs intervene. The applicant is also requesting relief from Development Standard 3-05.2.2.B.1 where a minimum setback distance of five (5) feet for a pedestrian refuge area must be maintained between any enclosed structure and a PAAL. The applicant is proposing a three- (3) foot sidewalk in its place.

The site is within the boundaries of the 12th Avenue/Valencia Area Plan, which provides land use guidance.

IV. Transportation Policies
Intent Statement: These policies are intended to ensure the integration of new development and road improvements, ensure the safety of neighborhood residents, reduce traffic flow by discouraging through traffic, and to ensure that new development is responsive to the use of alternative modes of transportation.

Policy 8. Provide safe and efficient pedestrian access throughout the Plan area.
a. Require sidewalks in all new private and public development per the adopted sidewalk policy.

Guideline 1. Utilize landscaped areas, curbs and sidewalks to define public, semi-public, and private areas.

Based on the above policies, the 12th Avenue/Valencia Area Plan supports relief from Development Standard 2-08.4.1.C, as site conditions cannot accommodate the sidewalk to the west.

Since the major traffic and pedestrian activity will be occurring on the south side of the new addition, the 12th Avenue/Valencia Area Plan does not support the request to reduce the required sidewalk from five feet to three feet. Based on the submitted site plan, it appears that redesign of the landscaped island adjacent to the dumpster location would accommodate the required 24-foot PAAL and still accommodate the required five-foot pedestrian refuge area.

COMMENTS: The Zoning review Section does not recommend or support the proposed DSMR for the following reasons.

1. The DSMR request is for support or approval of a modification of a development standard requirement. The elimination of a development standard can not be processed through a DSMR application.

2. This site must meet full code compliance as a result of a greater than 25% expansion of vehicular use area. The proposed parking area along the west side of the site will be all new pavement and striping. The parking area can and should be redesigned to function and meet development standards 3-05 (vehicular use areas).

3. The DSMR is requesting elimination of the required sidewalk along the west side of the building, DS 2-08.4.1.C. As indicated in comment one, the DSMR is for a modification of a development standard and not elimination. Based on the proposed site plan the required sidewalk has been eliminated.

4. All required sidewalks within a project must be a minimum of four in width. The sidewalk from the street that must connect to the onsite pedestrian circulation must also be four feet in width. There is no hardship indicated on the plan that prohibits or limits the width of the sidewalk to three feet.

5. The sidewalk between the loading zone and the new addition must be a minimum of four feet in width. The loading zone can be relocated and re-striped to allow the construction of the four feet wide sidewalk at this location.

The five-foot wide pedestrian refuge area with a four-foot sidewalk is required along the south side of the new addition. The pedestrian refuge area is a continuation of the required continuous pedestrian circulation path as well as an accessible path. The re-design of the new building can be made to accommodate the required width.

Request: DS 2-08.4.1.C - Modify on-site pedestrian circulation system to remove section along west side of existing building.
DS 3-05.2.2.B.1 - Reduce width of pedestrian circulation system along south side of building and to the ROW from five (5) and four (4) feet respectively to three (3) feet.

The first Development Standard Modification Request (DSMR) listed above has been approved by the Community Design Review Committee (CDRC) without conditions.

The second Development Standard Modification Request (DSMR) listed above has been denied.

Prior to approval of the site plan, it must be modified to show physical separation between the proposed loading zone and sidewalk along the south side of the building. The pedestrian circulation system must be relocated so as not to be between the loading zone and the dock.

Although the Environmental Services comments do not relate to this DSMR, John Clark must approve the site plan prior to Zoning approval to ensure compliance with Environmental Services concerns.
