COMMENTS: Zoning cannot approve the DSMR as requested.

1. The DSMR is intended for a modification request to a development standard requirement. A DSMR may be approved by CDRC (and possibly with conditions) if the proposed modification is found to be acceptable. A DSMR may not be requested to eliminate a development standard requirement.

a. The DSMR request asking CDRC to eliminate the requirement of D.S.3-05.2.2.B.1. In my opinion, the applicant has not demonstrated a modification that can be considered by CDRC. In order to eliminate the pedestrian refuge with a four-foot sidewalk the applicant must apply for a Board of Adjustment variance. Zoning cannot approve this DSMR as requested.

b. A new carport/garage structure is to be constructed along the west side of the property. The pedestrian refuge area has been placed between the structure and the PAAL. Per the DSMR request a sidewalk is to be constructed between the parking spaces and the PAAL and is to connect to the pedestrian circulation. Per development standards D.S. 2-08.4.1.F, sidewalks or pedestrian refuge areas may not be located between a motor vehicle parking space and the PAAL providing access to that parking space. This DSMR cannot be requested based on the placement of this sidewalk.

*** Reviewer's personal comment: It is clear in development standards 2-08.4.1.F that a pedestrian refuge area or a sidewalk may not be placed between a parking space and a PAAL that provides access to that parking space. It is also clear that per development standards 3-05.2.2.B.1 a five-foot wide pedestrian refuge area is required between a PAAL and an enclosed structure. My question is, would the new building, parking garage if it has garage doors be considered an enclosed structure? If so, a five-foot wide pedestrian refuge area is required between the PAAL and the enclosed structure. In some cases maybe even this one both DS 2-08.4.1.F. and DS 3-05.2.2.B.1 contradict each other. (Personally I don't feel that we should require a pedestrian refuge adjacent to a carport or garage.)
