COMMENTS: Conditional Approval - See comments

1. Per the applicants response to the Zoning Reviewer's comment eight (8) dated March 25, 2004 all units will be barrier free accessible. Per the land use code 3.6.1.4.A.5 only 25% of the units must be barrier free accessible. If all the units are to be barrier free as stated in the applicant's response comments the plan must demonstrate how the units will be provided with the accessibility from the street and or a parking space. I do not believe that this requirement has been demonstrated on the drawing. In addition accessibility must be a concrete sidewalk not D.G. as proposed by the response comment to the Zoning Reviewers comment 13 dated March 25, 2004. If the number of accessible lots is reduced to the 25% (3 units) and the units selected are accessible from the street and or the parking space to the front door via concrete sidewalks and access ramps where required this comment can be disregarded.

2. I do not believe that a development standard modification can supersede a Land Use Code Requirement. Therefore I will make the following comment related to the Zoning Reviewers comment 13 dated March 25, 2004.

Per Land Use Code section 3.6.1.4.G.2 every RCP shall have a pedestrian circulation system connecting all elements of the RCP to all units. The system is to be physically separated from the vehicular circulation system, except where the system intersects a street. I do not believe the plan demonstrates that this requirement has been met but I also acknowledge that per DS 3-01.3.3.A, exceptions to the sidewalk requirements could be satisfied if the argument can be made under one of the exceptions and if this exception can supersede the Land Use Code requirement for the RCP.

I will leave this determination to Patricia Gehlen Principal Planner of the Zoning Review Section.
