COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is August 9, 2023.

2-06.2.0 APPLICATION SUBMITTAL REQUIREMENTS

1. COMMENT: 2-06.2.3 – A development package is not required for this project. This permit should have been submitted as a building fence permit using, https://docs.tucsonaz.gov/Forms/tucsonpermitapp, submission type “Building Residential One- or Two-family: New Building Residential One- or Two-family. New Residence, Addition, Pool, Porch, Fence or Wall, Demolition, etc.”

2-06.4.7 - General Notes

3. COMMENT: 2-06.4.7.A.4 – The use listed under Development Data is not correct and should be shown as vacant. Zoning was not able to find any submittals for development of these parcels.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

4. COMMENT: 2-06.4.8.C – Provide the following information for both Dodge & 4th: right-of-way (ROW) width, distance from center line to curb and curb to property line. The distance from Dodge center line to curb should be 18’-0” and from curb to property line should be 12’-0”. For 4th the ROW width from center line to property line should be 30’-0”, center line to curb should be 18’-0” and from curb to property line should be 12’-0”.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

5. COMMENT: 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined.

6. COMMENT: 2-06.4.9.O – The maximum height of a wall or fence within a perimeter yard shall be six feet, see UDC Article 6.6.2.I. The plan is not consistent with the height of the proposed fence: Sheet 1 under Development Data, Type of Construction you list “7’ HIGH”, Construction Note 2 lists “7’ HIGH” but details 1 & 2 show 8’-0”, clarify what the proposed height is. Either way if the fence is over 6’-0” in height it is required to meet perimeter yard setbacks. As this site boarders on two (2) streets, one street setback is 20 feet or one and one-half the height of the proposed wall (H), measured from the street property line, whichever is greater, the other street is 10’-0”, owners’ choice. Interior perimeter yard setbacks are the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). If wall heights greater than 6’-0” are requested and perimeter ;yard setbacks cannot be met a Design Development Option (DDO) must be submitted and approved for wall height, DDO application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/forms/DDO_for_Setback_and_Height_UDC_8.11.20.pdf. A DDO is a separate submittal from the building plan and shall be submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”.
