08/19/2022 | STEVE SHIELDS | ZONING | REVIEW | Reqs Change | PDSD TRANSMITTAL FROM: PDSD Zoning Review PROJECT: Outdoor Seating at Robert’s Restaurant Development Package (1st Review) DP22-0171 TRANSMITTAL DATE: August 19, 2022 DUE DATE: August 25, 2022 COMMENT: Resubmit revised drawings and a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is June 22, 2023. 2-06.2.0 APPLICATION SUBMITTAL REQUIREMENTS 1. COMMENT: 2-06.2.4 – The development package is designed to allow for concurrent review of any site related reviews only, remove sheets 3-5 from DP set and remove all references to building code from sheet 1. 2-06.3.0 FORMAT REQUIREMENTS 2. COMMENT: 2-06.3.12 – Revise the Sheet Index to only show the first two sheets. CONTENT REQUIREMENTS 3. COMMENT: 2-06.4.2.D – Provide the page number and the total number of pages in the package (i.e., sheet xx of xx) on all sheets. 4. COMMENT: 2-06.4.3 – Provide the development package case number, DP22-0 , adjacent to the title block on all sheets. 5. COMMENT: 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall be drawn at a minimum scale of three-inch equals one mile, 6. COMMENT: 2-06.4.4.C – Label the section, township, and range; section corners; and the scale on the location map. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 7. COMMENT: 2-06.4.7.A.4 – The existing and proposed use listed under General Note 4 is not a use classified per the UDC and should be listed as “Food Service: Excluding Soup Kitchens subject to Use Specific Standards 4.9.4.M.1 and 4.9.13.P. 8. COMMENT: 2-06.4.7.A.6.a – As Grant Rd is designated as an Arterial on the COT MS&R Map provided a general note stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R)” 2-06.4.8 - Existing Site Conditions The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided. 9. COMMENT: 2-06.4.8.A – The site boundary does not appear to be shown correctly. Based on Cure Plan DP20-0123 and the Assessor’s Map the 3 vehicle parking spaces and sign along the Grant Road Frontage and the3 southernmost vehicle parking spaces along the east property line are now located within the right-of-way (ROW) along Grant Road. Also, you are showing the dumpster location and 7 vehicle parking spaces on the property to the north, if this is actually the case and the property is owned by the same owner a lot combination is required. A survey maybe required. 10. COMMENT: 2-06.4.8.C – Provide the following information for both Grant & Edith, right-of-way width, and dimensioned width of paving, curbs, curb cuts, and sidewalks. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. COMMENT: Per UDC Article 7.4.3.E.2 If an expansion is 25% or greater or if a series of expansions cumulatively results in a 25% or greater expansion in floor area, the requirements of this section apply to the entire site. As you are proposing a 25% expansion the following comments apply. 11. COMMENT: 2-06.4.9.H.5 – Provide a fully dimensioned vehicle use area. 12. COMMENT: 2-06.4.9.H.5.a – Provide a detail for both a standard and accessible vehicle parking space. 13. COMMENT: 2-06.4.9.H.5.a – The number of provided vehicle parking spaces may not include any spaces located within in the ROW. 14. COMMENT: 2-06.4.9.H.5.a – Per 2018 IBC Chapter 11 Section 1106.5 Van spaces. For every six of fraction of six accessible parking spaces, at least one shall be a van accessible parking space. It does not appear that any of the accessible spaces meet the requirements of ICC A117.1-2009 Section 502.2. 15. COMMENT: 2-06.4.9.H.5.d – General Note 10 states that there are “2 EXISTING” long-term bicycle parking spaces on site, clearly show the location on the plan. 16. COMMENT: 2-06.4.9.H.5.d – Provide a detail for both the short- & long-term bicycle parking that demonstrates that the requirements of UDC Article 7.4.9.B, .C & .D are met. 17. COMMENT: 2-06.4.9.H.5.d – Based on aerial photos it does not appear that the requirement of UDC Article 7.4.9.B.1.g are met. 18. COMMENT: 2-06.4.9.O – Provide the required street perimeter yard setbacks on the plan. Street perimeter yard setbacks are based on UDC Article 6.4.5.C.2 and Table 6.4.5.C-1 for both Grant & Edith. COMMENT: Per TSM Section 7-01.2.B.2 If the expansion is 25% or more, these provisions apply to the existing use or structure, as well as the expansion. As you are proposing a 25% expansion the following comments apply. 19. COMMENT: 2-06.4.9.R – Per TSM Section 7-01.4.1.A At least one sidewalk is required to a project from each street on which the project has frontage. Provide a sidewalk from the building out to Grant road. 20. COMMENT: 2-06.4.9.R – Per TSM Section 7-01.4.1.B A sidewalk is required adjacent and parallel to any access lane or PAAL on the side where buildings are located. Provide a sidewalk along the north side of the building. 21. COMMENT: 2-06.4.9.R – Provide a width dimension for the sidewalk along the east side of the building.
