COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is February 07, 2023

2-06.2.0 APPLICATION SUBMITTAL REQUIREMENTS

1. Previous comment 1 - This comment was not addressed. The plans still have references to “BULDING CODE INFORMATION 2018 IBC & CODE ANALYSIS DATA. Also remove sheets 4 & 5 as they will not be reviewed under this DP. COMMENT: 2-06.2.4 – The development package is designed to allow for concurrent review of any site related reviews. Remove all references to building code review from the plan

CONTENT REQUIREMENTS

2. Previous comment 3 - This comment was not addressed. The legal description should be “TUCSON LOT 3 & ELY PTN LOT 2 BLK 99”. COMMENT: 2-06.4.2.B – Provide a brief legal description within the title block.

3. Previous comment 4 - This comment was not addressed. COMMENT: 2-06.4.2.D – Provide the page number and the total number of pages in the package (i.e., sheet xx of xx) on all sheets.

4. Previous comment 6 - This comment was not addressed. COMMENT: 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three-inch equals one mile, and provide the following information.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

8. Previous comment 13 - This comment was not addressed. COMMENT: 2-06.4.7.A.6.a – As this site is located within a Historic Preservation Zone (HPZ) Historic review is required and must be approved prior to approval of this DP. Historic application/requirements can be found at: https://www.tucsonaz.gov/files/pdsd/Preservation/HPZ_Review_Application_Package_2020.pdf, and is a separate submittal from the building plans submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using Submission Type “Historic Review”. Once approved provide the Historic case number adjacent to the title block on all sheets and provide a general note stating the case number date of approval and if applicable any conditions of approval.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

9. Previous comment 14 - This comment was not addressed. COMMENT: 2-06.4.8.A - Provide site boundary perimeter information, including bearing in degrees, minutes, and seconds.

10. Previous comment 15 - This comment was not fully addressed, provide the dimensioned width of curbs, curb cuts, and sidewalks.
COMMENT: 2-06.4.8.C – Provide the following information for 12th St, Railroad Ave & 4th Ave. right-of-way width, recordation data, type and dimensioned width of paving, curbs, and sidewalks.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

11. Previous comment 20 - Until the variance is secured Zoning cannot approved this plan. If the variance is approved provided the variance case number adjacent to the title block on all sheets and provided a general note stating the case number, date of approval, what was modified and if applicable any conditions of approval. COMMENT: 2-06.4.9.H.5.a – Per UDC Article 7.4.6.K A street or alley cannot be used for maneuvering directly into or from any parking space located wholly or partially outside the public right-of-way. That said a Board of Adjustment for Variance will be required for the proposed accessible parking space.

12. Previous comment 22 - This comment was not addressed. COMMENT: 2-06.4.9.H.5.d – Demonstrate on the plan that the requirements of UDC Articles 7.4.9.B.1.d, .e, .g, 7.4.9.B.2.a, .h, 7.4.9.C.2.c, .d are met.

13. Previous comment 23 - This comment was not addressed. Either meet the requirements of TSM Section 7-01 or provided documents that approved the assembly area as a use area. COMMENT: 2-06.4.9.R – As the new assembly area constitutes and expansion that is greater than 25% demonstrate that the requirements TSM Section 7-01 are met.
