| 06/13/2022 | STEVE SHIELDS | ZONING | REVIEW | Reqs Change | PDSD TRANSMITTAL FROM: PDSD Zoning Review PROJECT: Chick-Fil-A – Canopy Addition Development Package (1st Review) DP22-0009 TRANSMITTAL DATE: June 13, 2022 DUE DATE: June 06, 2022 COMMENTS: Resubmit revised drawings and a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is January 26, 2023. 2-06.2.0 APPLICATION SUBMITTAL REQUIREMENTS 1. COMMENT: 2-06.2.4 – The development package is designed to allow for concurrent review of any site related reviews. That said, remove all references to building codes from the plan. CONTENT REQUIREMENTS 2. COMMENT: 2-06.4.2.D - The page number and the total number of pages in the package (i.e., sheet xx of xx) shall be provided within the title block on all sheets. 3. COMMENT: 2-06.4.3 – Provide the development package case number, DP22-0009, adjacent to the title block on all sheets. 4. COMMENT: 2-06.4.4 - The project-location map, Vicinity Map, shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile. 5. COMMENT: 2-06.4.4.B - Identify regional watercourses within the square mile area of the location map. 6. COMMENT: 2-06.4.4.C - Section, township, and range; section corners; north and the scale will be labeled on the location map. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 7. COMMENT: 2-06.4.7.A.4 – The Fast Food Restaurant use listed under Project Data note 4 is not a use listed in the UDC. Review UDC Table 4.8-4: PERMITTED USES - COMMERCIAL AND MIXED USE ZONES, C-2 Zone and provide a use listed in the UDC and provide the Use Specific Standards for that use. 8. COMMENT: 2-06.4.7.A.6.a – As both Grant Rd & Tanque Verde Rd are listed as Arterials on the COT MS&R Map provide a general note stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R)”. 2-06.4.8 - Existing Site Conditions The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided. 9. COMMENT: 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: type and dimensioned width of paving, curbs, curb cuts, and sidewalks. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 10. COMMENT: 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined. 11. COMMENT: 2-06.4.9.J – It does not appear that the curb along Grant Rd is at future location but until comment 9 above is addressed Zoning cannot verify. If the existing curb is not at future location based on street cross sections provided in the COT MS&R Plan, found at: https://www.tucsonaz.gov/files/pdsd/plans/MSR.pdf, show the future curb location on the plan. 12. COMMENT: 2-06.4.9.O – The street perimeter yard setbacks listed under Project Data note 15 are not correct. Per the definition of Established Area Setback when a street has frontage along a street designated on the COT MS&R map the Established Area Setbacks do not apply. Street perimeter yard setbacks for this site are based on Developing Area Setbacks, UDC Article 6.4.5.C.2 & Table 6.4.5.C-1 ADT of 1,000 or greater, 21’ or the (H) The height of the proposed exterior building wall, measured from the back of existing curb or future curb, greater of the two. Until comments 9 & 11 are addressed Zoning cannot verify street perimeter yard setback requirements.
