COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is January 02, 2023.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

1. The Main Gate review is a separate submittal from this DP and is submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Special Districts”. COMMENT: 2-06.4.7.A.6.a – Based on General Note 2 you are proposing to use the Main Gate UOD, this process will need to be approved prior to approval of this DP.

2. This comment was not addressed. Zoning was not able to find an expansion calculation on the plan. COMMENT: 2-06.4.7.A.8.c – As a building expansion is proposed provide a building area expansion calculation on the plan.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

3. This comment was not addressed. If you are going to use the shopping center parking calculation demonstrate that the site meets the definition of a shopping center. If you are going to use the Main Gate Overlay demonstrate that the site meets the requirements of the Main Gate parking requirements. You shall use one or the other but you cannot combine the two different calculation. COMMENT: 2-06.4.9.H.5.a – As this project is a proposed change of use from General Merchandise Sales, excluding Large Retail Establishment to Food Service: Excluding Soup Kitchens, provide a break down of all uses on the entire site along with the square footage and demonstrate that the of a Shopping Center are maintained, see UDC Article 11.3.9.C.3 Definition of Shopping Center.

4. This comment was not addressed. COMMENT: 2-06.4.9.H.5.a – The parking calculation appears to be using both the UDC and Main Gate UOD, use one or the other.

5. This comment was not fully addressed, no details were provided. COMMENT: 2-06.4.9.H.5.d – If Short- & Long-term bicycle parking is required clearly show the location on the plan and provide a detail that demonstrates how the requirements of UDC Article 7.4.9 are met.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Revised development package
06/15/2022 MGAYOSS1 DESIGN PROFESSIONAL REVIEW Denied A complete MGD/historic Design Package is still needed, as indicated in my previous review on 2/16/22.

Once all comments for the second submittal of the Development Package are received, please proceed with the following steps:

1. Submit the complete Design Package through our FileDrop portal, which should include the Special Districts application form, plus all materials specified in the application form to demonstrate compliance with MGD and historic requirements; ONCE YOU SUBMIT IT, PLEASE SEND ME AN EMAIL SO I CAN TRACK THE DESIGN PACKAGE DOWN; Jodie Brown (our Historic Preservation Officer) and I will look at the packet and may require additional materials and may request clarifications;
2. Once Design Packet is ready to be accepted, I'll give you instructions for payment of the $505.50 MGD/historic review fees;
3. Once fees are paid, I will forward the Design Packet to the Design Professional and the Historic Preservation Officer for review. I will also coordinate with the Department of Environmental Services, Park Tucson, and the Building Official to ensure that refuse collection, parking, and ADA parking are addressed in your proposal;
4. Depending on the results of the Design Professional's review, adjustments to the Design Package may be required; at this point you can request a meeting with the Design Professional to discuss;
5. Once you get a positive review from the Design Professional and the Historic Preservation Officer, then the PDSD Director will make a decision on the Design Package.
