Also, since the site is adjacent to a property that is a contributor to the West University National Historic District, the project will need to go through historic review by our Historic Preservation Officer (MGD C-18.g).

Once the first round of comments are issued from the reviewers for the Development Package (DP21-0364), you can proceed with the submittal of your Design Packet for review by the Design Professional and the Historic Preservation Officer. So here are your next steps:

1. Obtain the first round of comments for the Development Package;
2. E-mail me (maria.gayosso@tucsonaz.gov) the complete Design Packet, which should include the Special Districts application form, plus all materials specified in the application form to demonstrate compliance with MGD and historic requirements; Jodie Brown (our Historic Preservation Officer) and I will look at the packet and may require additional materials and may request clarifications;
3. Once Design Packet is ready to be accepted, I'll give you instructions for payment of the $505.50 MGD/historic review fees;
4. Once fees are paid, I will forward the Design Packet to the Design Professional and the Historic Preservation Officer for review. I will also coordinate with the Department of Environmental Services, Park Tucson, and the Building Official to ensure that refuse collection, parking, and ADA parking are addressed in your proposal.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is January 02, 2023.

2-06.2.0 APPLICATION SUBMITTAL REQUIREMENTS

1. COMMENT: 2-06.2.4 – Remove the building code references from the DP such as “2018 IBC CODES – SF. CALCS”.

2. COMMENT: 2-06.4.2.A – The title block shall include the proposed name of the project or subdivision, or if there is no name, the proposed tenant's name;

3. COMMENT: 2-06.4.2.A – There is a reference to “UNIVERSITY RESTAURANT T.I.” on the plan. As you are proposing an expansion of building are this is not a TI. Remove this reference from the plan.

4. COMMENT: 2-06.4.3 – Provide the development package case number, DP21-0364, adjacent to the title block on all sheets.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

5. COMMENT: 2-06.4.7.A.2 – As this proposed use and expansion is part of a larger site provide the overall site square footage and acreage in General Note 1.

6. COMMENT: 2-06.4.7.A.4 – Based on Presubmittal, T21PRE0184, there was a distillery component to this project. Clarify if the distillery component is still proposed, if so either a Zoning Examiner Special Exception Procedure, Section 3.4.3 or Main Gate UOD will need to be approved prior to approval of this DP.

7. COMMENT: 2-06.4.7.A.6.a – Depending on how comment 6 is addressed if either option is used provided the case number adjacent to the title block and provide a general note stating the case number date of approval and if applicable any conditions of approve.

8. COMMENT: 2-06.4.7.A.6.a – Based on General Note 2 you are proposing to use the Main Gate UOD, this process will need to be approved prior to approval of this DP.

9. COMMENT: 2-06.4.7.A.8.b – Remove General Note 9 from the plan as lot coverage is not applicable in the C-1 Zone, see UDC TABLE 6.3-4.A: DIMENSIONAL STANDARDS FOR THE C-1, C-2, C-3, OCR-1, & OCR-2 ZONES.

10. COMMENT: 2-06.4.7.A.8.c – As a building expansion is proposed provide a building area expansion calculation on the plan.

11. COMMENT: 2-06.4.7.A.8.d - When the proposed site is part of a larger site, the calculations encompass the entire site, whether existing or proposed. If the project is being phased, calculations must show that, at each phase, requirements are being met.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

12. COMMENT: 2-06.4.9.H.5.a – As this project is change the proposed use from General Merchandise Sales, excluding Large Retail Establishment to Food Service: Excluding Soup Kitchens, provide a break down of all uses on the entire site along with the square footage and demonstrate that the of a Shopping Center are maintained, see UDC Article 11.3.9.C.3 Definition of Shopping Center.

13. COMMENT: 2-06.4.9.H.5.a - Based on Presubmittal, T21PRE0184, there was roof top seating proposed it is not clear if this square footage is included in the vehicle parking calculation. Per UDC Article 7.4.3.F.4 any outdoor areas necessary to provide the service to the public or conduct the activity shall be included in the calculation.

14. COMMENT: 2-06.4.9.H.5.a – Based on the Zoning Administrators letter, dated 09/17/2012 and DP16-0209 patio expansion this site currently is required to provided 15 vehicle parking spaces. As you are removing vehicle parking for this project and an expansion is proposed the vehicle parking calculation needs to clearly show how much addition square footage, building and roof seating area, is proposed so that the required number of vehicle spaces can be verified.

15. COMMENT: 2-06.4.9.H.5.a – The parking calculation appears to be using both the UDC and Main Gate UOD, use one or the other.

16. COMMENT: 2-06.4.9.H.5.d – The bicycle parking space calculation requirements cannot be verified until comment 13 has been addressed. The calculation provided is not correct as Short- & Long-term bicycle parking would be required for any expansion. Also, again either you need to use the UDC or the Main Gate UOD bicycle parking requirements.

17. COMMENT: 2-06.4.9.H.5.d – If Short- & Long-term bicycle parking is required clearly show the location on the plan and provide a detail that demonstrates how the requirements of UDC Article 7.4.9 are met.

18. COMMENT: 2-06.4.9.R – Per TSM Section 7-01.4.1.C A sidewalk is required adjacent to any parking space accessed by a PAAL where the space is located on the same side of the PAAL as any building and no other parking spaces or PAALs intervene. Show the required sidewalk along the south side of the building. This sidewalk shall meet the requirements of TSM Sections 7-01.4.2 & .3.

The Main Gate Overlay requires that properties adjacent to listed buildings complement their historic elements. Historic staff will be reviewing the proposed design to ensure that these elements are present on the new construction.
