TRANSMITTAL DATE: February 2, 2022

DUE DATE: February 8, 2022

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is January 02, 2023.

2-06.3.0 FORMAT REQUIREMENTS

1. COMMENT: 2-06.3.12 – An index of sheets in the development package shall be provided on the first sheet.

CONTENT REQUIREMENTS

2. COMMENT: 2-06.4.1 - The name, mailing and email addresses, and phone number of the primary property owner of the site, and developer of the project shall be provided on the right half of the cover sheet.

3. COMMENT: 2-06.4.2.D - The page number and the total number of pages in the package (i.e., sheet xx of xx) on the plan

4. COMMENT: 2-06.4.3 – Provide the development package case number, DP21-0363, adjacent to the title block on all sheets.

5. COMMENT: 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three-inch equals one mile, and provide the following information.

6. COMMENT: 2-06.4.4 – Remove all references to density from the location map.

7. COMMENT: 2-06.4.4.C – Provide the section, township, and range and label the section corners on the location map.
2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

8. COMMENT: 2-06.4.7.A.4 – The existing use shown under General Note 1 is not correct and should be cultural.

9. COMMENT: 2-06.4.7.A.6.a – As you are proposing an addition to this site a Mayor and Council Special Exception Procedure, Section 3.4.4 must be completed prior to approval of the DP. If approved provided the case number adjacent to the title block and provided a general note stating the case number, date of approval, and provide any conditions of approval.

10. COMMENT: 2-06.4.7.A.6.a – As a new special exception must be approved for this DP remove all references to SE-13-92 from the plan.

2-06.4.7.A.8 - For development package documents provide:

11. COMMENT: 2-06.4.7.A.8.a – The total floor area, existing plus proposed, shown on the plan is in consistent. The numbers in the vehicle parking, lot coverage & expansion are all different.

12. COMMENT: 2-06.4.7.A.8.a – Based on current aerial photos and information provided on this DP there have been two detached accessory structures and two water cisterns added to the site. The shed and chicken coop square footage needs to be added to all applicable calculations, i.e., vehicle & bicycle parking, lot coverage and the expansion calculation. Zoning was not able to find approved compliance reviews or permits for these structures. Provide approve compliance review or permit documentation for these two structures.

13. COMMENT: 2-06.4.7.A.8.b – The lot coverage calculation does not appear to be correct. Based on other numbers shown on the plan the existing & proposed building area should be 4516. 4516 plus the “PAVING COVERAGE AREA PROPOSED should equal 12386 for a lot coverage of 60.5%. It appears that the PAVING COVERAGE AREA PROPOSED includes vehicle use and pedestrian area. Per UDC Article 6.4.3 sidewalks are not part of the lot coverage.

14. COMMENT: 2-06.4.7.A.8.c – The expansion calculation is not correct. The existing cannot include the carport therefore the total existing would only be 3365 sq. ft. with the calculation being 1151 proposed learning lab divided by the existing square footage 3365 = 34% expansion.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

15. COMMENT: 2-06.4.8.C – Provide a dimension for the pavement width along Dodge.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

16. COMMENT: 2-06.4.9.H.5.a – The vehicle parking calculation does not appear to be correct but until comment 11 & 12 are addressed Zoning cannot verify the number required but based 4516 sq ft the required number should be 15 spaces. Additional comments maybe forth coming.

17. COMMENT: 2-06.4.9.H.5.d - Until comment 11 & 12 are addressed Zoning cannot verify the required number of bicycle parking spaces. Additional comments maybe forth coming.

18. COMMENT: 2-06.4.9.O – Per UDC TABLE 6.3-2.A: DIMENSIONAL STANDARDS FOR THE R-1, R-2, R-3, MH-1, & MH-2 ZONES, R-2 Zone, the required interior perimeter yard setback from the proposed building addition to the north and west property line is 10’-0” or ¾(H) = Height of the proposed exterior building wall, greater of the two. Based on the provided height of 16’-4” the required perimeter yard setback to the north & west property line is 12’-3”, proposed is 10’-3” to the north and 10’-4” to the west. Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A.
A Design Development Option (DDO) must be submitted and approved to reduce the required setback,
DDO application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/forms/DDO_for_Setback_and_Height_UDC_8.11.20.pdf. A DDO is a separate submittal from the building plan and shall be submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. If you have questions about the DDO application or process please contact Mark Castro at Mark.Castro@tucsonaz.gov.

19. COMMENT: Per UDC Article 6.6.3.B & 6.6.5.E.4.a detached accessory building are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line. The location of the chicken coop will require a Board of Adjustment for Variance. Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/files/pdsd/codes/Zoning_Administration_Application_BA_fillable.pdf. The Board of Adjustment is a separate submittal from this building plan and is submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. Contact of the Board of Adjustment is Mark Castro at Mark.Castro@tucsonaz.gov.

20. Based on current aerial photos and information provided on this DP there have been two cisterns added to the site. Show these cisterns on the plan. Zoning was not able to find approved compliance reviews or permits for these structures. Provide approve compliance review or permit documentation for these two structures.
