This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is December 27, 2022. CONTENT REQUIREMENTS 1. COMMENT: 2-06.4.3 – Provide the development package case number, DP21-0354, adjacent to the title block on all sheets. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 2. COMMENT: 2-06.4.7.A.4 – The use of the property shown under ZONING AND LAND USE INFORMATION is not correct and should be list as a UTILITY DISTRIBUTION SYSTEM SUBJECT TO USE SPECIFIC STANDARDS 4.9.11.A.1, .2, .5, .8, .9, .11 AS PERMITED AS A Zoning Examiner Special Exception Procedure, Section 3.4.3. 3. COMMENT: 2-06.4.7.A.6.a – Any modification to this distribution site is required to go through the Special Exception (SE) Procedure, Section 3.4.3. The procedure must be approved prior to approval of the DP. The SE application can be found at: https://www.tucsonaz.gov/files/pdsd/forms/ZESE_Application.pdf, and the contact for this process Peter McLaughlin – Peter.McLaughlin@tucsonaz.gov. Once this process is approved provide the SE case number adjacent to the title block on all sheets and provide a general note stating the case number, date of approval, what was approved and if applicable any conditions of approval. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 4. COMMENT: 2-06.4.9.O – Per UDC Article 6.6.3.B Detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line. The proposed shade structures shown along Beverly may not be located west of the reservoir. A Board of Adjustment for Variance is required. 5. COMMENT: 2-06.4.9.O – It does not appear that proposed canopy C meets perimeter yard setbacks to the east property line. As no section was provided for canopy C Zoning use the section provided for canopy B with a height of 22’-8” which requires a perimeter yard setback of 17’-0”. At a minimum a neighbor’s setback waiver is required. 6. COMMENT: 2-06.4.9.Q - Per UDC Article 6.6.3.C Accessory structures shall not exceed 12 feet in height, unless attached to a principal structure. A Board of Adjustment for Variance is required.
