| 10/22/2021 | STEVE SHIELDS | ZONING | REVIEW | Reqs Change | PDSD TRANSMITTAL FROM: PDSD Zoning Review PROJECT: 4659 E 22nd Street Development Package (1st Review) DP21-0262 TRANSMITTAL DATE: October 22, 2021 DUE DATE: October 28, 2021 COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is September 28, 2022. CONTENT REQUIREMENTS 1. COMMENT: 2-06.4.3 – Provide the development package case number, DP21-0262, adjacent to the title block on all sheets. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 2. COMMENT: 2-06.4.7.A.6.a – As 22nd Street and Swan Rd are designated as Arterial Streets of the COT MS&R Map provide a general note stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R).” 2-06.4.8 - Existing Site Conditions The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided. 3. COMMENT: 2-06.4.8.C - The following information regarding 22nd & Swan shall be provided: dimensioned width of paving, curbs, curb cuts, and sidewalks. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 4. COMMENT: 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined. 5. COMMENT: 2-06.4.9.H.5 – Based on current aerial photos it appears that the existing concrete shown to remain near the northwest corner of the building is raised above the level of the paving. If this is the case demonstrate that the 24’ PAAL width is maintained, see UDC Article 7.4.6.D and figure 7.4.6-A. 6. COMMENT: 2-06.4.9.H.5 – Demonstrate that the dimensional requirements of UDC Article 7.4.6.F.4 are met at the north end of the western vehicle use area. 7. COMMENT: 2-06.4.9.H.5 - There is an angled vehicle parking space shown near the southeast corner of the site. Provide a PAAL width dimension from the northeast corner of this parking space to the parking spaces to the north. 8. COMMENT: 2-06.4.9.H.5.a – The vehicle parking space calculation is not correct. Per UDC Article 7.4.3.A.2 Each Land Use Group (Group), except for Residential and Storage, has a standard minimum parking formula. The standard formula applies to every Land Use Class (Class) within that Group, except for those Classes specifically listed in the parking tables. That said the ratio use is for Marijuana Dispensary Off-Site Cultivation Location only. As a Marijuana Dispensary is not specifically listed in the parking tables the correct ratio is 1 space per 300 sq. ft. GFA. Revise the calculation 9. COMMENT: 2-06.4.9.H.5.a - The vehicle parking space calculation shall include the number of required/provide van accessible parking spaces. 10. COMMENT: 2-06.4.9.H.5.a - Detail “A” sheet 1 shows the parking spaces that allow vehicles to overhang the end of the parking spaces. As there are several parking spaces shown along the west property per UDC Article 7.4.6.H.1 Barriers, such as post barricades or wheel stop curbing, are required in a vehicular use area to prevent vehicles from extending beyond the property lines, to prevent cars from damaging adjacent landscaping, walls, or buildings. Demonstrate how a vehicle parking in the spaces along the west property line will be prevented form overhanging the property line or damaging the adjacent building. 11. COMMENT: 2-06.4.9.H.5.a - Detail “B” sheet 1 shows the accessible parking spaces that allow vehicles to overhang the end of the parking spaces. As the accessible parking space are shown along the west property per UDC Article 7.4.6.H.1 Barriers, such as post barricades or wheel stop curbing, are required in a vehicular use area to prevent vehicles from extending beyond the property lines, to prevent cars from damaging adjacent landscaping, walls, or buildings. Demonstrate how a vehicle parking in the accessible space will be prevented form overhanging the property line or damaging the adjacent building. 12. COMMENT: 2-06.4.9.H.5.a - \As detail “B” sheet 1 does not match what is proposed on site clearly demonstrate where the accessible parking space signs will be located. 13. COMMENT: 2-06.4.9.H.5.a - Per UDC Article 7.4.6.C.4 Parking spaces may not be located under, or within five feet of, a vertical line intersecting the ground and any structural element extending from a billboard, including, but not limited to, overhangs, cantilevered beams, and elevated walkways. Show the extents of the billboard called out on the plan and demonstrate that none of the vehicle parking spaces are within five feet of, a vertical line intersecting the ground and any structural element extending from a billboard. 14. COMMENT: 2-06.4.9.H.5.a - Per UDC Article 7.4.6.D.2.b Minimum Width Requirement When Adjacent to Barrier, A motor vehicle off-street parking space must have a minimum width of ten feet when the side(s) of the parking space abuts a vertical barrier over six inches in height, other than a vertical support for a carport. That said demonstrate that the vehicle parking space shown north of the accessible parking spaces meets the 10’-0’ wide as it is adjacent to a light pole called out to remain. 15. COMMENT: 2-06.4.9.R – As parking vehicles are allowed to overhang the sidewalk along the south side of the existing building demonstrate that the 4’-0” wide sidewalk width is maintained.
