This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is July 07, 2022. CONTENT REQUIREMENTS PREVIOUS COMMENT 1 - This comment was not fully addressed, sheets 17 – 24 do not have the required case number. COMMENT: 2-06.4.3 – Provide the development package case number, DP21-0172, adjacent to the title block on all sheets. 2-06.4.7.A - Zoning and Land Use Notes 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. PREVIOUS COMMENT 8 - COMMENT: 2-06.4.9.E – Until land split S21-043 is approved Zoning cannot approve this DP. PREVIOUS COMMENT 210 - This comment was not addressed correctly. UDC Article 7.4.6.F.2.a.(2) states “at least 1’-0”” and the plans now show 0.9’. COMMENT: 2-06.4.9.H.5 – Per UDC Article 7.4.6.F.2.a.(2) show the required 1’-0” setback from the building to the drive-through. PREVIOUS COMMENT 15 - As the proposed short-term bicycle parking is directly adjacent to the building demonstrate on the plan/detail that the requirements of UDC Article 7.4.9.B.2.g are met. COMMENT: 2-06.4.9.H.5.d – Provide a detail for the short- & long-term bicycle parking that demonstrates how the requirements of UDC Articles 7.4.9.B, .C & .D are met. PREVIOUS COMMENT 16 - This comment was not addressed. Per COT MS&R map, https://www.tucsonaz.gov/files/pdsd/plans/MSR_Map.pdf, the future right-of-way (ROW) for Valencia Rd is 200’. Sheet C2.1 shows the existing ½ ROW at 75’. Review the COT M&R plan, https://www.tucsonaz.gov/files/pdsd/plans/MSR.pdf, 200’ cross section and provide the future curb & sidewalk on the plan. COMMENT: 2-06.4.9.J – Show and dimension the future curb and sidewalk on the plan. PREVIOUS COMMENT 17 - Your comment response states “Acknowledged. CC&R’s to cross access”. Not sure what this means but if the CC& R’s are address cross access provide a copy of the recorded CC&R’s with your next submittal. COMMENT: 2-06.4.9.L – As access is proposed across the proposed parcel to the east provide some type of easement or agreement. The easement/agreement will need to be recorded prior to approval of this DP. Zoning acknowledges the access easement across the parcel to the west. PREVIOUS COMMENT 15 - This comment was not addressed correctly. See previous comment 16 above and provide a street perimeter yard setback from the back of future curb. COMMENT: 2-06.4.9.O – The street perimeter yard setback listed under “SITE DATA” is not correct. Per UDC Article 11.4.6 definition of Established Area Setback, major streets and routes do not qualify for established area street perimeter yard setbacks. Per UDC Article 6.4.5.C.2 and Table 6.4.5.C-1, ADT of 1,000 or greater, the required street perimeter yard setback to Valiance is 21’ or the height of the building exterior wall, greater of the two, measured to he back of future curb. Provide a street perimeter yard setback dimension from the proposed building to the back of future curb\. PREVIOUS COMMENT 21 - Zoning was not able to find a dimension on the detail on sheet C1.4. COMMENT: 2-06.4.9.R – Clearly demonstrate on the plan that the sidewalk area between the proposed required area for the short-term bicycle parking and the curb is not less than 4’-0”, see TSM 7-01.4.3.A. PREVIOUS COMMENT 22 - It appears that the proposed monument sign is partially within the future ROW a Board of Adjustment is will be required. COMMENT: 2-06.4.9.W - Indicate the locations and types of proposed signs (wall, free-standing, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. Also provide a general note stating “ALL SIGNAGE REQUIRES SEPARTE PERMITS”. Zoning acknowledges that this comment should have been provide on the previous review but as there are prior comments that need to be address the following comment shall be addressed: COMMENT: 2-06.4.9.O – The “S , R” perimeter yard setbacks listed under Site Date are not correct. Per UDC TABLE 6.3-4.A: DIMENSIONAL STANDARDS FOR THE C-1, C-2, C-3, OCR-1, & OCR-2 ZONES, C-2 Zone, Nonres Use to Nonres Zone the required perimeter yard setback is 0’-0”. This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants and water harvesting. 1. UDC 2-10.4.1 Identification and Descriptive Data A. All improvements and site information, such as adjacent rights-of-way and property lines, shown on the landscape plan will be identical in size and location to those shown on the base plan (site plan or tentative plat). Should amendments be required to the base plan through the review process, the same amendments will be made to the landscape plan which will then be resubmitted along with the base plan. Ensure that Zoning and Engineering comments are addressed prior to landscape section approval. 2. Please provide all landscape calculations on the landscape plan, including required trees for the parking areas and landscape border coverage. 3. Up to 5’ of the future right of way can be used for landscape with the approval of the Transportation & Mobility Department. If using the right of way, ensure that these notes are on the plans. Standard Notes for Planting in ROW It is the owner’s responsibility to keep the Sight Visibility Triangles (SVT), and the pedestrian access area clear of vegetation at all times, per Unified Development Code (UDC) Technical Standards Manual Section 10. a. It is the owner responsibility to keep a 5’ wide by 7’ tall clear pedestrian access open across the entire property. b. It is the owner responsible to keep vegetation from growing past the curb line clear and keep a 15’ high clear zone over the travel lane. c. Final plant locations must be in compliance with all utility setback requirements. d. The owner understands that if the City of Tucson Transportation Department or any utility company needs to work within the ROW in the landscaped area, plants and irrigation may be destroyed without replacement or repair. e. The owner takes full liability for this landscape and irrigation, and any damage to roadway, sidewalk and utilities. f. The only private irrigation equipment that is allowed within the ROW are lateral lines, tubing and emitters that are not under constant pressure. All other equipment must be on private property. (excluding water meter) g. Contractor to obtain a Right Of Way permit prior to construction within the right-of-way. 4. The parking area does not meet the intent of the UDC in terms of including trees in the parking lot to shade the asphalt. The intent is to provide as much shade on the asphalt as possible, and the requirement is 1 tree per 4 parking spaces; trees are expected to be placed within the parking area itself, not along the sides. Trees are to be distributed evenly throughout the parking area, UDC 7.6.4.1.B.1, UDC Technical Standards Manual 5-01-.3.2 and UDC 7.6.4.B.1.a. 5. Acacia greggi and Celtis pallida are not appropriate species to provide shade over the asphalt, the plans submitted previously with Mesquites provided that shade. 6. Mitigation plants are in addition to the landscape requirements detailed in UDC 7.6. They may not be used to satisfy the requirements of street landscape borders or parking area planting. 7. The landscape border calculations are not complete, actual square footage must be provided.
