Thank you for the opportunity to comment on DP21-0138 Arby’s, new restaurant, Tucson Marketplace; 1st Submittal, a development package application for a 0.85 acre site, which is located southeast of the intersection of East Tucson Marketplace Boulevard and South Park Avenue. The property is zoned Planned Area Development 15 (PAD-15) and the project would support the development of a commercial restaurant.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority approves proposed project.
Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following note into the general notes of the revised development plan. This project is located approximately 4 miles north of Tucson
International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.

The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).

1. "That prior to the City's approval of any construction permit for a permanent building, the
property owner shall record the Avigation Easement which discloses the existence, and
operational characteristics of the Tucson International Airport to future owners or tenants
of the property and further conveys the right to the public to lawfully use the airspace
above the property. The Avigation Easement shall be recorded in a manner with the
Pima County recorder which shall document it as having title liability. The content of
such documents shall be according to the form and instructions provided.
The current property owner or person authorized to sign on behalf of the current property owner
shall complete, sign, and record the Avigation Easement. Please record the Avigation
Easement with the Pima County Recorder’s Office. Once the Avigation Easement is recorded
please send a complete copy of the recorded easement document to Tucson Airport Authority
by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

2. The pipe and inlet calculations provided in the Taco Bell report do not account for the flows from this portion of the site (DA 5). Please provide an exhibit showing the areas draining to each offsite inlet, hydrologic calculations for each and new pipe/inlet calculations to demonstrate sufficient capacity to convey the additional flows proposed to reach them.
3. Sufficient slopes do not appear to be provided in the parking areas to provide positive drainage. Pleaser revise grading.
4. Please provide grading and total volumes provided for water harvesting areas.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is May 30, 2022.

CONTENT REQUIREMENTS

1. COMMENT: 2-06.4.3 – Provide the development package case number, DP21-0138, adjacent to the title block on all sheets.

2. COMMENT: 2-06.4.6 – On the reduced-scale map of the PAD indicate the location of the portion being developed.

3. COMMENT: 2-06.4.7.A.6.a – Remove General Note 16 as this project does not boarder on a street designated on the COT MS&R map.

4. COMMENT: 2-06.4.7.A.8.a – General Note 4 it is not clear if the 2,437 SF includes the patio or not. This may affect the required calculations, i.e. vehicle parking etc.

5. COMMENT: 2-06.4.7.A.8.d – Bridges Tracking Tables – until comment 4 above is addressed Zoning cannot verify several of the tracking table requirements. Currently there appears to be errors under several categories within the table: Accessible Parking Provided, FLOOR AREA RATIO (FAR) - OVERALL TUCSON MARKETPLACE PROJECT TOTALS TO DATE, PRIOR APPROVED DEVELOPMENT TOTALS TO DATE. Add the entire DP case number to OPEN SPACE REQUIREMENTS - SUB AREA "A" for this project.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

6. COMMENT: 2-06.4.8.A – Clarify why the property dimensions shown on the plan differ from what was recorded on final plat -REPLAT OF LOT 2” recorded under sequence #20202870478.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

7. COMMENT: 2-06.4.9.H.5 – Show the required 1’-0” setback from the building to the drive-through lane, see UDC Article 7.4.6.F.2.a.(2).

8. COMMENT: 2-06.4.9.H.5 – Show and dimension the required stacking spaces on the plan, see UDC Article 7.4.7.

9. COMMENT: 2-06.4.9.H.5.a – Provide a typical parking space detail shall be provided for both standard, 90 degree and angled, parking spaces and those for the physically disabled. The detail shall provide the Parking angle, Space width, Space depth and a location dimension for the wheel stops shown.

10. COMMENT: 2-06.4.9.H.5.a – The proposed van accessible parking space does not meet the requirements of ICC A117.1-2009 Section 502.4.1.

11. COMMENT: 2-06.4.9.H.5. – The provided accessible parking space sign detail does not have any dimensions, provide them.

12. COMMENT: 2-06.4.9.H.5.d – Provide a fully dimensioned short – term bicycle parking space detail that demonstrates how the requirements of UDC Articles 7.4.9.B.1, .2.
