COMMENT: 2-06.4.7.A.6.a – Per UDC Article 4.9.11.A.1 the setback of the facility, including walls or equipment, shall be 20 feet from any adjacent residential zone, and per UDC Article 4.9.11.A.2 where a facility is not enclosed within a building, the surrounding screen shall be used as the building wall for the purposes of setbacks. The proposed fence called out under Key Note 14 does not meet the required 20’-0” setback to the north property line. 7. The proposed fence called out under Key Note 14 does not meet the required 20’-0” setback to the north property line, proposed setback appears to be a little less than 10’-0”, no setback dimension was provided on the plan. 8. COMMENT: 2-06.4.7.A.6.a – UDC Article 4.9.11.A.2 where a facility is not enclosed within a building, the surrounding screen shall be used as the building wall for the purposes of setbacks. The proposed fence called out under Key Note 14 does not meet the required street perimeter yard setback. Street perimeter yard setbacks are based on UDC Article 6.4.5.C.1. As this site borders on two (2) streets one (1) street perimeter yard setback shall meet the requirements of UDC Article 6.4.5.C.1.a, the minimum required front street perimeter yard is 20 feet or one and one-half the height of the proposed wall (H), measured from the street property line, whichever is greater, and the other shall meet the requirements of UDC Article 6.4.5.C.1.b the side street perimeter yard is ten feet. The owner may choose which street is the front and side street. In this case Zoning recommends that Columbus Bl be used as the front street as it appears the fence meets the 20’-0” setback requirement, no setback dimension was provided on the plan. 32nd St would then be used as the side street. The proposed fence does not meet the required 10’-0” side street perimeter yard setback, proposed setback is 0’-0” 9. COMMENT: 2-06.4.7.A.6.a – The existing/proposed use does not meet the requirements of UDC Article 4.9.11.A.9, the use shall be located wholly within an enclosed building or within an area enclosed on all sides with a masonry wall or compact evergreen hedge, not less than six feet, nor more than ten feet, in height. 2-06.4.8 - Existing Site Conditions The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided. 10. COMMENT: 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to the site shall be provided: the right-of-way width, and dimensioned width of paving, curbs, curb cuts, and sidewalks. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 11. COMMENT: 2-06.4.9.O – Remove what appears to be a setback line from the plan as it is not correct and address perimeter yards setbacks as requested above.
