The property is zoned Planned Area Development 15 (PAD-15), with the proposed use being food service excluding soup kitchens. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority previously commented on the Major Change to PAD-15, comment letter is dated March 9th, 2018, with this comment letter being adopted on Page B7-B8 of City of Tucson Ordinance 11552. This proposed project area is contained within the areas identified by this City of Tucson Ordinance. The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised development plan. Conditions of approval: 1. "According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. As this project site develops, all applicants shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp" 2. "That prior to the City's approval of this development package and before any further subdivision of any parcel contained within PAD Sub-Area B-III, the property owner shall record the Avigation Easement for all of PAD Sub-Area B-III, which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided. The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is December 28, 2021. CONTENT REQUIREMENTS 1. COMMENT: 2-06.4.3 – Provide the development package case number, DP20-0257, adjacent to the title block on all sheets. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 2. COMMENT: 2-06.4.7.A.6.a – Zoning acknowledges that it is difficult to track the development going on at the Bridges due to the number of different Engineering firms working in the area. That said there are 5 DPs that you didn’t show on the tracking tables, 4 in Sub Area “A” and 1 in Sub Area “B-IV”. The DP numbers are DP18-0233, DP19-0077, DP20-0050, DP20-0073 & DP20-0147, please add their development information to your table. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 3. COMMENT: 2-06.4.9.H.5 – Per UDC Article 7.4.6.H.1 Barriers, such as post barricades or wheel stop curbing, are required in a vehicular use area to prevent vehicles from extending beyond the property lines , to prevent cars from damaging adjacent landscaping , walls, or buildings , overhanging adjacent sidewalk areas , and/or driving onto unimproved portions of the site. There are three (3) areas where it appears vehicles will be able to access unimproved areas of this site: 1) the west end of the cross walk that runs from near the trash enclosure across the access lane, it appears that including the flush landing there is enough space for a vehicle to assess the area to the west. 2) Along the west end of “LOT 5”. 3) Along the northeast end of “LOT 4”. 4. COMMENT: 2-06.4.9.H.5.d – Detail “H” sheet 8 demonstrate that there is at least 2’-6” from the edge of rack to the vehicle parking space to the northwest, see UDC Article 7.4.9.B.2.g. 5. COMMENT: 2-06.4.9.L – All proposed easements will need to be recorded prior to approval of this DP. 6. COMMENT: 2-06.4.9.R – Demonstrate on the plan that there is at least 4’-0” clear between the proposed accessible vehicle parking space signs and the proposed building. 7.
