New restaurant / 1st Submittal, Received October 12, 2020 Thank you for the opportunity to comment on DP20-0204, Rudy's at Ajo and I-10; 1st Submittal, a development package application for an approximately 1.58 acre site, located southeast of the intersection of East Ajo Way and Kino Parkway. The property is zoned Commercial Zone (C-2), with the proposed development to construct a new restaurant. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority previously commented on the rezoning case (C9-20-07 and comment letter dated June 29, 2020) where this project is proposed to be occurring. The Tucson Airport Authority recognizes that the rezoning conditions that were provided in the comment letter for the rezoning case are identified as Condition 10 in the plan set for this project. As a friendly reminder, the Tucson Airport Authority requests the applicant to provide a copy of the recorded Avigation Easement for the entire property associated with rezoning case C9-20-07 and to make sure to satisfy the condition for FAA Form 7460 as part of this project. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied.
