§77.9 Construction or alteration requiring notice.
(e) You do not need to file notice for construction or alteration of:
(1) Any object that will be shielded by existing structures of a permanent and substantial nature or
by natural terrain or topographic features of equal or greater height, and will be located in the
congested area of a city, town, or settlement where the shielded structure will not adversely affect
safety in air navigation;

The project description of proposed buildings not to exceed 40 foot AGL (approximately 2556 AMSL) at 2100 East Ajo Way, Tucson, AZ 85713 will not require FAA study under Part 77 as it meets the conditions described above for construction not requiring notice.

SUBJECT: Rezoning for (C9-20-07) Dorsett - Ajo Way based on Development Package of (DP20-0189) Ajo Marketplace


The above referenced development package has been conditionally-approved by the City Development Review Committee (CDRC) to prepare the rezoning ordinance for Mayor & Council adoption. The ordinance may be scheduled for Mayor & Council adoption at any time.

Conditions of the rezoning per the decision of the Mayor & Council are hereby met on the Development Package.

No permits or development approvals [which includes excavation, grubbing, grading, paving] may be granted that are in furtherance of the rezoning request until the 30 days have lapsed and the conditions of rezoning have been met per UDC 3.5.3.J.6.

The applicant is responsible for notifying Alexandra Hines, Lead Planner, at alexandra.hines@tucsonaz.gov when the 30 days near. At that time, staff will review the ordinance adopted by Mayor & Council and the applicant will receive an approval notification to obtain the permit for the development package.
