5.4. MAJOR STREET AND ROUTES SETBACK ZONE (MS&R)

5.4.2. APPLICABILITY
The MS&R standards apply to the following uses on property, any portion of which abuts or is adjacent to a street designated on the City's or County's MS&R Plan:
A. New structures;
B. Changes of use, including new structures occurring on vacant land;
C. Uses of land or structures legally existing as of June 27, 1988, that are expanded in floor area, lot coverage, parking, seating capacity, or any other expansion of use, as listed below. Exception. An expansion of off-street parking for a nonconforming existing use that increases the number of spaces to the minimum required by the UDC for that use is exempt from counting toward the 25% expansion: (See Figure 5.4-A.)
1. If the expansion is less than 25%, the MS&R applies to the proposed expansion. The remainder of the use or structure shall be governed by provisions in force at the time of initial approval for the use or structure;
2. If the expansion is 25% or more, the MS&R applies to the proposed expansion and to the parking and landscaping standards that apply to the overall development; or,
3. Expansions that occur after the effective date of the MS&R shall be cumulated in determining the 25% expansion; and,
D. When one or more of the standards of the MS&R, the Gateway Route, or the Scenic Corridor Zone (SCZ) (Section 5.5) apply to the same street, the most restrictive standards apply.

Provide expansion calculations.

Ensure that Zoning and Engineering comments are addressed prior to landscape section approval.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is May 7, 2020.

1. General comment: The entire site must be shown on the submitted development package. The proposed expansion does not appear to necessitate additional parking. Correct other items as noted in the following comments.

2. 2-06.4.2.B - A brief legal description is to be included in the title block. Per Pima County records the parcel legal description is “36TH & MISSION NELY PTN OF BLKS 1 & 2”.

3. 2-06.4.3 – Update relevant case numbers which are provided adjacent to the title block to include C9-81-03 and C9-83-23.

4. 2-06.4.7.A.1 – Correct general note 2. Existing zoning is R-3 and C-1.

5. 2-06.4.7.A.2 - List the gross area of the site/subdivision by square footage and acreage.

6. 2-06.4.7.A.4 – Update general note 3 to include “subject to use-specific standard 4.9.7.B.6.”

7. 2-06.4.7.A.8.c – Update general note 4 to include percentage of building, lot area, or vehicular use area expansion. If the building(s) or lot area have been previously expanded, those calculations shall be included. Calculations do encompass the entire site.

8. 2-06.4.8.A - Provide site boundary/subdivision perimeter information, including bearing in degrees, minutes, and seconds, with basis for bearing noted, together with distances in feet, to hundredths of a foot, or other functional reference system.

9. 2-06.4.8.B - All existing easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated.

10. 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks.

11. 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined. If the property is being rezoned, use those boundaries and classifications.

12. 2-06.4.9.O – All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown.

13. 2-06.4.9.Q – Provide the square footage and the height of each commercial, industrial, or business structure and the specific use proposed within the footprint of the building(s).
