COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is April 09, 2021.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

Previous comment 7. The documents were not provided. Addressed 2-06.4.9.E - As it appears that some type of land split is proposed for this site provide a copy of the recorded deed and legal description with your next submittal.

Previous comment 8. This comment was not addressed. Provide some type of barriers at the east end of the northern most access lane that will provide access to future development to the east. This also applies to the access lanes that provide access at the southeast and southwest ends of the site. 2-06.4.9.H.5 - Per UDC Article 7.4.6.H.1 Barriers, such as post barricades or wheel stop curbing, are required in a vehicular use area to prevent vehicles from extending beyond the property lines, to prevent cars from damaging adjacent landscaping, walls, or buildings, overhanging adjacent sidewalk areas, and/or driving onto unimproved portions of the site. That said there are 3 locations that require some type of barrier to prevent vehicle access to the unimproved portions of the site, one at the northeast, one at the southeast, and one at the southwest.

Previous comment 12. This comment was not fully addressed. Detail 7 Sheet L-3.01 does not address UDC Articles 7.4.9.B.1.e, 7.4.9.B.2.a, .f & .h. Detail 2 Sheet L-3.02 does not address UDC Articles 7.4.9.B.2.h or 7.4.9.D.5. 2-06.4.9.H.5.d - Keynote 21 Sheet 6 references "BIKE RACK, SEE LANDSCAPE PLANS FOR DETAIL". Zoning was not able to find the detail so provide the detail number and sheet that it is located on in this keynote. This keynote also needs to clarify if these are short or long term. Provide a detail for both the short- and long-term bicycle parking. These details shall address all requirements of UDC Articles 7.4.9.B, .C, & .D.

RE: DP20-0073 / Woodspring Suites, new hotel / 2nd Submittal, Received July 22, 2020

Thank you for the opportunity to comment on DP20-0073, Woodspring Suites, new hotel; 2nd Submittal, a development package application for an approximately 1.94 acre site, located southwest of the intersection of East Tucson Marketplace Boulevard and South Kino Parkway. The property is zoned Planned Area Development 15 (PAD-15), with the proposed development being a hotel.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority provided a comment letter on the 1st submittal of this project, comment letter dated May 4, 2020, but it appears the development plan was never revised to incorporate these comments. The Tucson Airport Authority is resubmitted these comments with the 2nd submittal review of this project.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised development plan.

Conditions of approval:

1. According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp

Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following note into the general notes of the revised development plan. This project is located approximately 3 miles northwest of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.

The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).

1. That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

1) For the proposed water harvesting area. Recheck the volume of water entering each basin. For example, the large basin to the south "SA-10". For the 5 year event, the volume of water entering the basin, based on the tributary area, will not fill the basin. Suggest a grade brake along the centerline of the PAAL so that the basin to the south and the basins to the east have tributary impervious area. Update grading plan and corresponding pages in the drainage report as needed
