Thank you for the opportunity to comment on DP20-0045, Brioso at The Bridges; 2nd Submittal, a development package application for an approximately 10.2 acre site, located southeast of the intersection of South Park Avenue and East 37th Street. The property is zoned Planned Area Development 15 (PAD-15), with the proposed development being a multi-family residential development.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority previously commented on the Major Change to PAD-15, comment letter is dated March 9th, 2018, with this comment letter being adopted on Page B7-B8 of City of Tucson Ordinance 11552. This proposed project area is contained within the areas identified by this City of Tucson Ordinance.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised development plan.

The applicant’s comment response letter for the first submittal of this project made reference to these notes but these notes were not present in the 2nd submittal of the project.

Conditions of approval:

1. According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp”

2. That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

3. For only residential uses - The developer shall provide the Airport Disclosure Statement form, at time of sale, to the new property owners with new unit purchases. In the event the development of any residential uses does not involve the sale of new units, but is instead offering rental residential units to the public, the new tenant of the rental unit shall be provided a copy of the Airport Disclosure Statement form. The intent of the Airport Disclosure Statement form is to educate and notify the new residents that they are living near an airport. The content of such documents shall be according to the form and instructions provided.

The new property owner or new tenant shall forward a signed copy of the Airport Disclosure Statement form to the Tucson Airport Authority, using the mailing address provided below.

SUBJECT: Brioso at the Bridges
DP20-0045, 2nd Submittal

Tucson Electric Power Company (TEP) has reviewed the development plan submitted June 30, 2019. TEP is unable to approve the plan at this time.

There are primary voltage lines and facilities along Park Ave right of way that are not depicted on the submitted
plans. Cannot approve plans as we cannot determine if there are conflicts with TEP facilities. In order for TEP to approve the plan, our facilities and easements must be depicted on the plans.

Enclosed is a copy of a TEP facility map showing the approximate location of the existing facilities. All costs associated with the relocation of the facilities in conflict will be billable to the developer.
