Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is January 28, 2021. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) 1. COMMENT: 2-06.3.5 - Remove the Development Package PDSD approval stamp from all sheets. Reserve a three-inch by five-inch space in the lower right quadrant of each sheet for an approval stamp. The approval stamp will be applied electronically by PDSD staff. 2. COMMENT: 2-06.4.3 - Provide the development package case number, DP20-0028, adjacent to the title block on each sheet. 3. COMMENT: 2-06.4.7.A.4 - Add note acknowledging the use-specific standards that apply. Commercial Service Use Group - Alcoholic Beverage Service (bar), excluding a large bar (18,000 square feet or more) is subject to use-specific standards 4.9.13.P. 4. COMMENT: 2-06.4.7.A.6 - Add a general note acknowledging the subject site is located within and compliant with the Airport Environs Zone and the Flood Hazard Zone. 5. COMMENT: 2-06.4.7.A.6.a - Add a general note, listing the activity numbers associated with the subject site; T09SA00110 and T16SA00037, Zoning Administration Special Development Requests and Requirements, as well as activity number T15OT01400 Certificate of Compliance. 6. COMMENT: 2-06.4.7.A.8.c - Include a calculation demonstrating the actual percentage of building and vehicular use area expansion. 7. COMMENT: 2-06.4.8.A - Provide site boundary perimeter information, including bearing in degrees, minutes, and seconds, with basis for bearing noted. 8. COMMENT: 2-06.4.8.C - Include the right-of-way width, recordation data (Page 4, Book 9 M&P), including the widths of the paving, curbs, curb cuts and sidewalks. 9. COMMENT: 2-06.4.9.F - Demonstrate the existing zoning classifications with clearly defined boundaries on and adjacent to the project (including across any adjacent right-of-way). 10. COMMENT: 2-06.4.9.H.4 - Add "(PUBLIC)" below the "29th STREET" label on the site plan, indicating the street is public. 11. COMMENT: 2-06.4.9.H.5 - Per UDC Article 7.4.6.D. Motor Vehicle Use Area Dimensions, the PAAL must have a minimum of a two-foot setback when adjacent to a wall in order to provide clearance for fire, sanitation, and delivery vehicles. In order to meet the two-foot PAAL setback, the parking spaces to the east of the existing structure can be reduced to 18-feet long. 12. COMMENT: 2-06.4.9.H.5.a - Per International Building Code, two accessible (ADA) parking spaces are required when the site is comprised of 26 to 50 parking spaces. 13. COMMENT: 2-06.4.9.H.5.d - Add a general note addressing required and provided short-term bicycle parking design in accordance to UDC 7.4.9. Bicycle Parking Design Criteria. Demonstrate a parked bicycle with a six-foot by two-foot dimension on either side of the bicycle rack in order to ensure the parked bicycle does not impede on-site pedestrian access. 14. COMMENT: 2-06.4.9.J - Draw the Major Streets and Routes (MS&R) right-of-way lines for 29th Street, including the MS&R future setbacks, sidewalks, right-of-way lines, sight visibility triangles, etc. Future setbacks must be met and compliant with the MS&R overlay zone prior to the approval of this project. If the standard is not met, the applicant can apply for the MS&R Right-of-Way Use Modification Request (UDC Article 5.4.7). The dimensional standards can be found in the Major Streets and Routes Plan. 15. COMMENT: 2-06.4.9.O - Draw the actual current and future setback dimensions on the site plan. Per UDC Article 6.4.5.C. Street Yard Perimeter, the minimum setback requirement for the subject site is 21 feet or the height of the building measured from the back of existing curb or future curb location. 16. COMMENT: 2-06.4.9.Q - Provide the height of the structure in the footprint of the building. 17. COMMENT: 2-06.4.9.R - Provide additional details regarding the pedestrian circulation path along the North and East side of the existing structure. Per the Technical Standards Manual, Section 7-01.4.1., Location Standards for Pedestrian Access, sidewalks are required for this pedestrian circulation path and based on the site plan, this area is not compliant because does not appear to be sidewalk. 18. COMMENT: 2-06.4.9.R - Demonstrate the design of the ADA ramp from the ADA parking space to the structure's accessible entrances. APPLICABILITY The MS&R standards apply to the following uses on property, any portion of which abuts or is adjacent to a street designated on the City's or County's MS&R Plan: A. New structures; B. Changes of use, including new structures occurring on vacant land; C. Uses of land or structures legally existing as of June 27, 1988, that are expanded in floor area, lot coverage, parking, seating capacity, or any other expansion of use, as listed below. Exception. An expansion of off-street parking for a nonconforming existing use that increases the number of spaces to the minimum required by the UDC for that use is exempt from counting toward the 25% expansion: (See Figure 5.4-A.) 1. If the expansion is less than 25%, the MS&R applies to the proposed expansion. The remainder of the use or structure shall be governed by provisions in force at the time of initial approval for the use or structure; 2. If the expansion is 25% or more, the MS&R applies to the proposed expansion and to the parking and landscaping standards that apply to the overall development; or, 3. Expansions that occur after the effective date of the MS&R shall be cumulated in determining the 25% expansion. Include a calculation demonstrating the actual percentage of building and vehicular use area expansion. If applicable show compliance with landscaping and screening requirements by locations, material descriptions, and dimensions. Specific plant or hardscape material shall be detailed on a landscape plan. A detailed landscape plan is required. In accordance with Section 2-11.0.0, Landscape Plan Requirements.
