PERMITTED USE OF MS&R RIGHT-OF-WAY AREA An approved site plan is required indicating how the project will comply with UDC standards when the MS&R right-of-way can no longer be used as part of the site. Such plan shall be an exhibit to an executed covenant for recordation stating the responsibility of the property owner, successor, or assignee as to the removal of improvements and compliance with the UDC at no cost to the City. The following comments are intended for Board of Adjustment Variance 7.6.4. LANDSCAPE STANDARDS Minimum Width Street landscape borders must be a minimum of ten feet wide as measured from the street property line. On streets designated as Major Streets and Routes (MS&R), the street landscape border must be measured from the future MS&R right-of-way line as determined by Section 5.4.4. Located on Site Street landscape borders must be located entirely on site, except that, if approved by the City or appropriate Engineer or designee, up to five feet of the required ten foot width may be placed within the adjacent right-of-way area or within the Major Streets and Routes (MS&R) right-of-way area on MS&R streets. A street landscape border is an area running the full length of the street property line bounding the site except for points of ingress-egress. Portions of the 5' on-site landscape buffer along Oracle Rd., indicated on future site plan are not located on-site. 7.6.5. SCREENING STANDARDS Whether or not required by this section, screens along a street frontage must be located on the development side of the street landscape border so that they do not obstruct the view of the street landscape border from the street. A future site plan will need to show how the site will meet minimum conditions of the UDC. Note: Any use of the ROW will need full and written permission from ADOT. |
