RE: DP19-0224 Dutch Bros at The Bridges, drive-thru coffee shop / 2nd Submittal, Received November 12, 2019

Thank you for the opportunity to comment on DP19-0224, Dutch Bros at The Bridges, drive-thru coffee shop; 2nd Submittal, a development package application for an approximately 0.69 acre site, located southwest of the intersection of South Campbell Avenue and East Cochise Vista. The property is zoned Planned Area Development 15 (PAD-15) with the proposed development being a commercial use as a food service.
This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority recognizes that the Avigation Easement was recording in a previous submittal; DP17-0204.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised development plan unless FAA staff with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA) has provided the applicant with written confirmation that filing FAA Form 7460 is not required. The Tucson Airport Authority utilized the Federal Aviation Administration (FAA) Notice Criteria Tool for this project and it identified that filing FAA Form 7460 is required. The following is the response the FAA Notice Criterial Tool provided for this proposed project; "your proposed structure will be in proximity to a navigation facility and may impact the assurance of navigation signal reception." This particular response is one of several listed which the FAA identifies as requiring FAA Form 7460 to be filed.
Conditions of Approval:
1. "According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"
