Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is July 29, 2020. *** Address the Zoning follow up comments. Some of the follow up comments have multiple parts. The previous comments have been left as reference for the reviewers and applicant 1. PREVIOUS COMMENT: Previous comment not addressed: Label the following under the location map: "NE ΒΌ of SECTION 17, T. 14 S., R. 14 E., G. & S.R.M., CITY OF TUCSON, PIMA COUNTY, ARIZONA" 2. PREVIOUS COMMENT: Previous comment not fully addressed 7: 2-06.4.4.C - Provide section, township and range listed below the location map. 3. NEW COMMENT: The square footage of the building shown on the first sheet does not match that shown on the second and third sheet; provide a constant square footage for the existing 2 story building. 4.PREVIOUS COMMENT: There does not appear to be 51 parking spaces on the parcel. Clarify where the additional parking spaces are located and if offsite provide a parking calculation for the uses the parking is being used or proposed. A recorded parking lease agreement will be required prior to approval of the DP. 5. FOLLOW UP COMMENT: We have received a letter from the law office of Neff & Boyer, P.C stating that the adjacent owners to the east of this development will not grant the developers of this project use of their parking spaces. The provided easement agreement seems to state that Broadmoor has a need for the "occasional" use of 20 parking spaces, it is not clear if these can be used as permanent parking spaces. Zoning cannot approve this site until this issue has been resolved or the correct number of parking spaces is provided. A reduction of parking spaces is possible through a separate IPP application.
