Dear Mr. Ornelas,
Thank you for the opportunity to comment on DP19-0087, Office, Shop & Storage, a development package application for an approximately 0.93 acre site, located southwest of the intersection of East Corona Road and South Frances Avenue. The property is zoned Industrial 1 (I-1), with the proposed development being a modular installation and new structure.
This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, FAA Part 77 airspace,
The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised site plan.

Conditions of approval:
1.
"According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"

"That development shall not cause or potentially affect aviation in the vicinity of the site, including but not limited to, physical obstructions to aircraft operations, interference with operations by way of electrical static, visual obstructions through emissions or glare, and/or the open storage of petroleum products, explosive materials, or materials which attract or lead to the concentration of wildlife."

Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following note into the general notes of the revised site plan. This project is located approximately 1 mile northeast of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.

The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4).
1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is April 8, 2020.

Follow up Comment: Include water harvesting infiltration area plan or revise index sheet


2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

Previous comment: Revise the use note to state the type transportation service to be provided. "Land Carrier", and clarify if this is a trucking company, taxicab service etc. and include the following UDC Use Specific Standard 4.9.13.Q.

Follow up Comment: Provide the UDC section 4.9.13.Q with the proposed use under parking calculation.




2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

Previous comment: It's not clear what the proposed use in the areas labeled with decomposed granite. All vehicle use areas must be paved with asphaltic concrete. Clarify the use of this area. If vehicles are allowed in this area revise the plan to indicate pavement unless there is an approval of a PDMR or TSMR. Contact Steve Shields for information if such a modification would be supported by Zoning and Engineering. Barriers to keep vehicle traffic off the unpaved areas will be required. In addition, there is a driveway proposed along the north side of the site which implies vehicle access, clarify.

Follow up Comment: It does not appear that this comment has been addressed completely this area will have to be paved if accessible for vehicular use. (Per the plan it appears that the rolling gate will provide vehicular access to the north area in questioned. If so this area will have to be paved with asphalted concrete as noted by previous comment. The pedestrian circulation will still need to be provide as long as vehicle access is proposed to Corona Road, Per TS 7-01.4.1.A)


7-01.4.1.A, At least one sidewalk is required to a project from each street on which the project has frontage, unless there is no vehicular access from a street because of a physical barrier, such as a drainage-way or an unbroken security barrier (e.g., a wall or fence). The sidewalk should be located to minimize any conflict with vehicular access to the project;

Previous comment: A sidewalk out to Corona must be provided per the T.S. section noted above. The sidewalk must from the onsite sidewalk to the required sidewalk on Corona. Label the ADA route from the onsite sidewalk to the street sidewalk, whether out to Corona or Frances.

Follow up Comment: It does not appear that this comment has been addressed completely see related comment above.
