New Development All new development proposed in the City of Tucson shall comply with the standards of this section. Exceptions Projects on a site or parcel that contains Protected Native Plants that will not be substantially impacted by development on the site as demonstrated by the applicant per this section and subject to approval through procedures established at the PDSD, provided that construction occurs per the approved plan. It appears that more than a few Protected Native Plants are impacted by development. The NPPO Application for Exception does not apply. Submit the following for review: 7.7.4. GENERAL PROVISIONS AND STANDARDS Submittal Requirements A Native Plant Preservation Plan in accordance with Section 2-12.0.0 of the Administrative Manual is required for all projects under the applicability of this section according to the methodology selected by the applicant as outlined in Section 7.7.5, Plant Preservation Standards Additional comments may apply. |

The property is zoned Rural Homestead (RH), with the proposed development being photo voltaic (solar panel) shade canopies. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan. Condition of approval: 1. "According to the FAA Notice Criteria Tool, 1) this project is located in proximity to a navigation facility and could impact navigation signal reception and 2) this project exceeds an instrument approach area by 123 feet and an aeronautical study is needed to determine if it will exceed subpart C of 14CFR Part 77. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes used which are used must also be identified with Form 7460.
